41( <br /> ordinance, and it shall not be necessary for such application to be <br /> accompanied by a check, as is required by said Section 7 , but said <br /> license fee shall be paid before a license is issued to said applicant. <br /> Section 5: That Section 31 of said Ordinance No. 1473, be <br /> and the same is hereby amended to read as follows: <br /> Section 31: Nothing in this ordinance shall be construed to <br /> prevent any retail licensed liquor dealer from serving patrons of any <br /> public restaurant or public dining room with intoxicating liquors with <br /> their meals, providing such restaurant or dining room complies with <br /> the provisions of this ordinance and is adjacent to and connected with <br /> the place of business of such retail licensed liquor dealer; provided, <br /> further, that no intoxicating liquors shall be served or consumed in <br /> any such restaurant or dining room during the hours when saloons are <br /> required to be closed,by the provisions of this ordinance. <br /> Section 6: That Section 32 of said Ordinance No. 1473 be, <br /> and the same is hereby amended to read as follows: <br /> Section 32: Wherever the words ' intoxicatirg liquor'are used <br /> in this ordinance they shall be taken to mean and include spirituous, <br /> vinous, fermented, malt, and other intoxicating liquors. <br /> Section 7: That Section 33 of said Ordinance No.1473,be,and <br /> the same is hereby amended to read as follows: <br /> Section 33:Any person violating any of the provisions of <br /> this ordinance shall , upon conviction thereof, be punished by a fine <br /> of not less than $75.00 , nor more than $100.00 , or by imprisonment <br /> for not less than twenty-five days, nor more than thirty days, or by <br /> both such fine and imprisonment, and if the holder of any liquor <br /> license, or any of his employees , is convicted of violating any of <br /> the provisions of this ordinance, for the first offense in addition <br /> to the fine or imprisonment the court shall make an order closing <br /> said place of business for thirty days and certify the same to the <br /> commissioner of safety of the city of Averett, and thereupon the com- <br /> missioner of safety shall direct the police officers to execute that <br /> part of the sentence 'closing said place of business for thirty days ' <br /> and it shall be the duty of the city attorney in all cases <br />
