<br />PGSF WMVD Storm and Combined Sewer - Construction Package 2 Removal and Disposal of Contaminated Soils <br />Project No. 180162 02 61 00 - 8 <br /> <br />e. Designated dangerous wastes as defined by Washington State Department of <br />Ecology's "Dangerous Waste Regulations" (Chapter 173 303 WAC) are not <br />expected at this site. If dangerous wastes are encountered, Contractor shall <br />notify Engineer and secure the area to prevent further release to the environment <br />and to prevent exposure to workers and the public. <br />3. Contractor shall verify that the receiving facility receiving each shipment of waste <br />from the site meets the following requirements: <br />a. The facility is fully licensed and permitted to accept the waste by the appropriate <br />County, State and Federal agencies <br />b. The facility will provide the treatment and or disposal services indicated and will <br />accept the quantity and types of waste generated under this Contract within the <br />time period of performance of this contract. <br />c. The facility must not have any significant violations or other environmental <br />conditions that affect the satisfactory operation of the facility. <br />d. The facility will provide a release of liability to the Owner for all soils accepted. <br />4. Contractor shall provide the name, location and applicable state and federal <br />identification number of the off-site facilities used for the treatment/disposal of <br />wastes from this project with the CMH Plan. <br />5. The Engineer reserves the right to contact the treatment/disposal facilities <br />designated by the Contractor and the appropriate regulatory agencies to verify the <br />information provided by the Contractor. <br />6. Contractor will arrange all other profiling requirements, forms, acceptance, and <br />scheduling at the disposal facility. Owner will sign disposal profile forms as <br />“Generator.” <br />7. Records <br />a. Records: Maintain records of all waste determinations, including appropriate <br />results of analyses performed, substances and sample location, the time of <br />collection, and other pertinent data as required by 40 CFR 280, Section 74 and <br />40 CFR 262 Subpart D, and other applicable regulations. Record transportation, <br />treatment, disposal methods and dates, the quantities of waste, the names and <br />addresses of each transporter and the disposal or reclamation facility and make <br />available for inspection, as well as copies of the following documents: <br />1) Manifests <br />2) Waste analyses or waste profile sheets <br />3) Certifications of final treatment/disposal signed by the responsible disposal <br />facility official <br />4) Land disposal notification records required under 40 CFR 268 for hazardous <br />wastes <br />5) Provide records in accordance with applicable federal, state, and local <br />regulations. <br />8. Documentation of Treatment or Disposal: <br />a. Transfer the materials to a treatment, storage, disposal facility which has EPA or <br />appropriate state permits and/or hazardous or special waste identification <br />numbers and complies with the provisions of all relevant solid waste disposal <br />regulations.
