Remove TESC measures in accordance with the TESC Plan unless directed <br />otherwise by the Owner’s Representative. <br />3. Removal procedures shall ensure that trapped sediments are removed and disposed <br />of correctly. Trapped sediments shall not be released to the storm drainage system. <br />4. When removing silt fences and diversions, ensure trapped sediments are removed <br />along with the fence and diversion materials, or are stabilized, so that sediment will <br />not be eroded in the future and carried into the surface water drainage system. <br />5. Components of the TESC measures shall be the property of the Contractor. The <br />Contractor shall be responsible for transport and disposal in accordance with local, <br />state, and federal regulations. <br />B. Final Clean-up shall be performed in accordance with the requirements of Section 01 74 <br />23 – Final Cleaning. <br />3.07 SYSTEM COMPLIANCE <br />A. The Project Representative and regulatory agencies will determine the effectiveness of <br />the TESC Plan. <br />B. Upgrade and modify TESC Plan as required within five days of written Correction Notice <br />from the Project Representative until effective. Refusal to modify and upgrade the TESC <br />Plan may result in the work being completed by the Project Representative and the cost <br />of the work being deducted from the Application for Payment. <br />C. Non-compliance with the erosion control requirements and water quality requirements <br />may result in stoppage of work. <br />END OF SECTION
