2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 33 March 5, 2026 <br />1 above, the request must be submitted in writing prior to the preconstruction conference, <br />2 subject to the provisions below. The working hours for the Contract shall be established at <br />3 or prior to the preconstruction conference. <br />4 <br />5 All working hours and days are also subject to local permit and ordinance conditions (such <br />6 as noise ordinances). <br />7 <br />8 If the Contractor wishes to deviate from the established working hours, the Contractor <br />9 shall submit a written request to the Engineer for consideration. This request shall state <br />10 what hours are being requested, and why. Requests shall be submitted for review no later <br />11 than *** 72 hours for daywork and 30 days for nightwork *** prior to the day(s) the <br />12 Contractor is requesting to change the hours. <br />13 <br />14 ***A Noise Variance, which shall be provided by the City, is required for Contract nighttime <br />15 work and included as an appendix in these specifications. If the Contractor or the Engineer <br />16 requests to do nighttime work that is not already established in the Contract, a 30-day notice <br />17 is required. The Engineer will then review the request and apply for the Noise Variance; the <br />18 City can deny the request at its sole discretion. Nighttime work is considered to be between <br />19 10 pm and 7 am unless otherwise stated. The following mitigation measures shall be in <br />20 effect during a Noise Variance, though there may be additional project specific <br />21 requirements: <br />22 •Back-up alarms shall be directional broad band type alarms. <br />23 •Trucks performing export haul shall have well maintained bed liners. <br />24 •Tailgate slamming will be prohibited. <br />25 •No construction work shall be allowed between 6 pm and 8 am on Saturdays, <br />26 Sundays, or federally recognized holidays unless otherwise stated in the <br />27 Noise Variance Permit.*** <br />28 <br />29 If the Contracting Agency approves such a deviation, such ap approval may be subject to <br />30 certain other conditions, which will be detailed in writing. For example: <br />31 1. On non-Federal aid projects, requiring the Contractor to reimburse the Contracting <br />32 Agency for the costs in excess of straight-time costs for Contracting Agency <br />33 representatives who worked during such times. (The Engineer may require <br />34 designated representatives to be present during the Work. Representatives who <br />35 may be deemed necessary by the Engineer include, but are not limited to: survey <br />36 crews; personnel from the Contracting Agencys material testing lab; inspectors; <br />37 and other Contracting Agency employees or third party consultants when, in the <br />38 opinion of the Engineer, such Work necessitates their presence.) <br />39 2. Considering the Work performed on Saturdays, Sundays, and holidays as working <br />40 days with regard to the contract time. <br />41 3. Considering multiple work shifts as multiple working days with respect to contract <br />42 time even though the multiple shifts occur in a single 24-hour period. <br />43 4. If a 4-10 work schedule is requested and approved the non-working day for the <br />44 week will be charged as a working day. <br />45 If Davis Bacon wage rates apply to this Contract, all requirements must be met and recorded <br />46 properly on certified payroll. <br />47
