City of Everett Point Industrial Center (EPIC) Bridge Project – Phase 2 Full Design <br />Page 15 of 43 <br />Assumptions: <br />The stormwater outfall improvement project is a standalone project currently being <br />carried out by the AGENCY’s stormwater division. <br />Environmental Justice Technical Memorandum is not required under current federal <br />directives. <br />Environmental Noise Analysis and Visual Analysis to be provided by CONSULTANT. <br />The EPIC bridge is assumed to be a transportation project in the Urban Industrial <br />Shoreline Environment. <br />An early coordination virtual meeting will be scheduled with WSDOT Local Programs at <br />or before the preliminary 30% design phase. Perteet will facilitate the meeting to review <br />the Project with WSDOT, confirm NEPA documentation levels and discuss the preferred <br />design before NEPA documentation is produced. <br />The initial preliminary NEPA document submittal typically occurs shortly after the 60% <br />design is submitted with a final submittal for signature near the 90% design completion <br />level. <br />No AGENCY preapplication meetings will be scheduled or conducted by Perteet. SEPA <br />process research and feedback with the AGENCY will be assumed to be handled by the <br />AGENCY along with clarification of any local permit needs. <br />Perteet will complete the Shoreline Master Program (SMP) consistency review and <br />prepare the Shoreline Substantial Development Permit (SSDP) application, including all <br />required supporting documentation such as a shoreline narrative, to demonstrate <br />compliance with the SMP. <br />AGENCY or other CONSULTANT staff will be responsible for permit submittals and <br />obtaining city permits and reviews related to any required development permit <br />and other local agency permits as required. <br />Federal funding will require compliance with WSDOT NEPA. A NEPA CE is assumed <br />to be the appropriate level of NEPA determination. A Preliminary and Final NEPA CE <br />Documentation Form will be completed by Perteet for AGENCY submittal to <br />WSDOT. Level of effort beyond a standard CE form (specialized documentation or EIS) <br />submittal is not accounted for in this scope of services. <br />Federal funding will require compliance with Section 106 of the NHPA with WSDOT as <br />lead agency. <br />Perteet will have access to the APE for the cultural resources survey. If at any time <br />human remains are encountered, work will cease, and local law enforcement, WSDOT, <br />the DAHP, and affected Tribes will be notified. <br />Cultural resources reporting may include up to one (1) archaeological site form and up to <br />two (2) historic property inventory forms. <br />An ESA Biological Assessment prepared according to WSDOT criteria with Stormwater <br />Checklist is assumed to be required as part of the NEPA evaluation. This document is to <br />be completed under subtask 4.3. <br />It is assumed that the Biological Assessment prepared under subtask 4.3 should satisfy <br />requirements under Everett Municipal Code (EMC) Chapter 19.37 for developments <br />within a protected special flood hazard area adjacent to the Snohomish River <br />(Shoreline).
