City of Everett Point Industrial Center (EPIC) Bridge Project – Phase 2 Full Design <br /> <br /> Page 17 of 43 <br /> <br />CONSULTANT shall review and Perteet will submit a draft version of the BA documentation to <br />the AGENCY for review and feedback prior to submitting the package to WSDOT for early <br />coordination review and feedback. Continued support for the BA review after formal submittal to <br />WSDOT during the formal Section 7 ESA consultation process may take months to years <br />depending on their schedule. This approach should allow for submittal feedback on this key <br />NEPA document. <br />This scope task is limited by the time and budget contained in the fee estimate. If additional <br />coordination time and effort is needed, Perteet may require a supplemental scope and fee to <br />address undetermined future efforts and will be identified with the AGENCY at that time. <br />Assumptions: <br /> Perteet will rely on the AGENCY’s stormwater design plans and analysis to inform the <br />biological assessment. If WSDOT recommends a Hi Run analysis, that analysis will <br />require engineering support and report integration may be provided at an additional fee. <br /> The biological assessment will not require any noise evaluations other than standard BA <br />noise assessments for terrestrial and aquatic impacts based on standard WSDOT variables <br />for noise and species impacts described in WADOT BA guidance. <br /> Perteet will assist the AGENCY to coordinate with WSDOT to consider the preliminary <br />BA. If substantial additional information and edits to the documents are required by <br />Perteet, those services shall be negotiated in an amendment to this Agreement before <br />proceeding. <br /> This task assumes that the use of Federal funding will require compliance with WSDOT <br />NEPA. A NEPA CE is assumed to be the appropriate level of NEPA determination. A <br />Preliminary and Final NEPA CE Documentation Form will be completed by Perteet for <br />AGENCY submittal to WSDOT. Level of effort beyond a standard CE form (specialized <br />documentation or EIS) submittal is not accounted for in this scope of services. <br /> Three (3) review cycles by WSDOT and NMFS. <br /> CONSULTANT will submit all deliverables/documents to the AGENCY after reviewing <br />Perteet’s submittals to the CONSULTANT. <br />Deliverables: <br /> Meeting notes. <br /> Draft BA for CONSULTANT and AGENCY review. <br /> Final Draft BA submitted to WSDOT for their initial review. <br /> Final BA submitted to WSDOT for their consultation with the Federal Services. <br /> Correspondence with WSDOT via email, as requested. <br /> <br />4.4 NPDES Construction Stormwater General Permit (CSGP) <br />The construction of the Project will require a Notice of Intent (NOI) to obtain a Construction <br />Stormwater General Permit. Because of likely contaminated soils and water in the APE, the <br />SWPPP prepared under Task 5 will be required for approval of the NOI. <br /> <br />Activities: <br /> Perteet will prepare and electronically submit to CONSULTANT a NOI after issuance of <br />SEPA exemption or SEPA determination.
