this code, all other applicable city ordinances and city standards, the alteration or <br /> vacation shall be approved. If the director and city engineer or hearing examiner find that <br /> the alteration or vacation does not comply with Chapter 18.28 of this code, or other <br /> applicable city ordinances and city standards, then the director and city engineer or the <br /> hearing examiner may disapprove the application stating reasons for disapproval or return <br /> it to the applicant for modification or correction with specific conditions or revisions that <br /> must be met for approval. <br /> 2. The alteration or vacation decision shall be in writing and shall include findings of <br /> fact and conclusions. <br /> 3. The decision made by the director and city engineer shall be an administrative <br /> decision. Any appeals shall be in accordance with Title 15 of this code, as amended, and <br /> Chapter 2.23 of this code, as amended. <br /> 4. The decision made by the hearing examiner shall be final and any appeal therefrom <br /> shall be in accordance with Title 15 of this code, as amended, and Chapter 2.23 of this <br /> code, as amended. <br /> EMC 18.12.040 Approval of the alteration or vacation. <br /> A. Approval of the alteration or vacation shall constitute authorization for the applicant <br /> to develop the alteration or vacation facilities and improvements as required in the <br /> approved preliminary approval. Development shall be in accordance with the plans and <br /> specifications as approved by the city subject to all conditions and requirements of the <br /> preliminary approval. <br /> B. Time Limits for Preliminary Approval. A preliminary alteration or vacation decision <br /> shall be issued by the director and city engineer or hearing examiner within one hundred <br /> twenty days as defined in Title 15 of this code, as amended. <br /> C. Expiration of Preliminary Subdivision Alteration or Vacation Approval. Final <br /> subdivision alteration or vacation approval must be obtained within five years of <br /> preliminary subdivision alteration or vacation approval, after which time the preliminary <br /> approval will be void. An extension may be granted by the city for one year if the <br /> applicant has attempted in good faith to submit the final plat alteration or vacation within <br /> the five-year time period; provided, however, the applicant must file a written request <br /> with the director requesting the extension at least thirty days before expiration of the five- <br /> year period. <br /> D. Expiration of Preliminary Short Subdivision Alteration or Vacation Approval. Final <br /> short subdivision alteration or vacation approval must be obtained within three years of <br /> preliminary short subdivision alteration or vacation approval, after which time the <br /> preliminary short subdivision alteration or vacation approval will be void. No extension <br /> may be granted by the city to the applicant. <br /> EMC 18.12.050 Final application submittal requirements. <br /> To submit for final alteration or vacation, the applicant shall have prepared all documents <br /> and maps, and performed all surveys as deemed necessary by the City in accordance with <br /> Section 18.08.070 of this title. <br /> EMC 18.12.060 Final review and approval process. <br /> 17 <br />
