Development shall be in accordance with the plans and specifications as approved by the <br /> city subject to all conditions and requirements of the preliminary approval imposed by <br /> the city. <br /> F. Time Limits for Preliminary Approval. A preliminary binding site plan decision shall <br /> be issued by the city within one hundred twenty days as defined in Title 15 of this code, <br /> as amended. <br /> G. Expiration of Preliminary Binding Site Plan Approval. Final binding site plan <br /> approval must be obtained within three years of preliminary binding site plan approval, <br /> after which time the preliminary binding site plan approval will be void. No extension <br /> may be granted by the city to the applicant. <br /> EMC 18.20.040 Review process for binding site plan with previously approved site plan. <br /> A. Required Review Process. An administrative binding site plan application with a <br /> previously approved site plan shall be reviewed as Review Process I, as defined in Title <br /> 15 of this code, as amended. <br /> B. Approval of Preliminary Binding Site Plan with a Previously Approved Site Plan <br /> Shall Consider the Land Division Evaluation Criteria and Development Standards in <br /> Chapter 18.28. The director and city engineer shall evaluate the proposed preliminary <br /> binding site plan application and its compliance with Chapter 18.28 of this code, all other <br /> applicable city ordinances, and city standards. <br /> C. Decision by the City. <br /> 1. If the director and city engineer find that the proposed binding site plan complies with <br /> Chapter 18.28 of this code, all other applicable city ordinances, city standards, and <br /> improvements required for the previously approved permit, the binding site plan shall be <br /> approved. If the director and city engineer find that the binding site plan is not in <br /> compliance with Chapter 18.28 of this code or other applicable city ordinances, city <br /> standards, and improvements required for the previously approved permit, the director <br /> and city engineer may disapprove the application stating reasons for disapproval or return <br /> it to the applicant for modification or correction with specific conditions or revisions that <br /> must be met for approval. <br /> 2. The binding site plan with previously approved site plan decisions does not require a <br /> written approval with findings of fact and conclusions. The city may state in a letter to <br /> the applicant the conditions that need to be met prior to approval or the city may execute <br /> the approval by signing the final binding site plan map. <br /> 3. The decision made by the director and city engineer shall be an administrative <br /> decision. Any appeals shall be in accordance with Title 15 of this code, as amended, and <br /> Chapter 2.23 of this code, as amended. <br /> D. Approval of the Binding Site Plan by the City. Approval of the binding site plan shall <br /> be determined based on a determination of whether the facilities and improvements as <br /> required by the previously approved permit action have been completed. The approval <br /> shall be based on total completion of improvements or an approved phasing plan by the <br /> city.
