All fish shall be removed from the project area during <br /> 2 construction under the direction of a qualified Fisheries Biologist before construction <br /> 3 begins. Fish exclusion shall comply with all local, state and federal permit <br /> 4 requirements. Unless otherwise specified in the permit requirements, capture <br /> 5 techniques shall be used that will minimize stress to the fish. Fish must be handled in <br /> 6 such a manner as to avoid and minimize fish mortality. Once fish are safely removed <br /> 7 from the site they must be carefully relocated to permanent open water downstream <br /> III <br /> 8 <br /> 9 of the work areas. <br /> 10 3. Qualifications <br /> 11 Supervisor: The Contractor's supervisor(s) who direct the day-to-day activities <br /> 12 associated with work in the Special Excavation Areas shall have a minimum of 3 <br /> 13 years of similar experience performing and supervising similar construction work <br /> 14 within the aquatic environment. Alternatively, the Contractor's supervisor shall have <br /> I <br /> 15 personally performed the work and/or directly supervised the construction and <br /> 16 successful completion of a minimum of three stream and or estuarine <br /> 17 restoration/construction projects similar to this project. <br /> I 18 <br /> 19 Fisheries Biologist(s): Fish exclusion activities and implementation of a Fish <br /> 20 Exclusion Protocol Plan shall only be completed under the direct, on-site supervision <br /> 21 of a person or persons declared a certified or associate "Fisheries Professional" by <br /> 22 the American Fisheries Society. <br /> 23 <br /> I <br /> 24 <br /> 25 4. Construction Staking <br /> Prior to the start of any work within the channels, breaches, and habitat berms the <br /> 26 Contractor shall stake the limits of excavation and habitat berm placement areas. Do <br /> 27 not proceed with work until the staking has been reviewed and approved by the <br /> 28 Engineer. <br /> 29 <br /> 30 The Contractor shall be responsible for establishing offset stakes and maintaining a <br /> 31 system of control so that the Engineer may verify that design intent is being met. <br /> 32 <br /> 33 5. Channel and Breach Excavation <br /> 111 34 Owner's Representative will provide initial fish removal prior to start of Contractor's <br /> 35 excavation and water control activities. Contractor shall notify Owner at least 7 days <br /> 36 in advance to request initial fish removal and provide access to the limits of work for <br /> 37 the Owner's Representative. Subsequent fish removal shall be the responsibility of <br /> 38 the Contractor and be performed in accordance with the Contractor's Fish Exclusion <br /> 39 Protocol Plan. <br /> I <br /> 40 <br /> 41 Excavate to the limits and grades shown on the Plans. Channel side slopes shall be <br /> 42 excavated to the natural angle of repose. Breach side slopes shall be as shown in <br /> 43 the Plans. The maximum deviation of the final surface elevations shall not be <br /> I44 greater than 0.5 feet. <br /> 45 <br /> 46 When the Contractor finds rock, rubble, or debris more than 6 inches in diameter at <br /> 111 47 the final surface elevation, it shall be over-excavated to at least 6 inches below <br /> 48 subgrade. The Contractor shall backfill the over-excavated areas up to the final <br /> 49 grade using suitable native material. This work shall be incidental to excavation. <br /> I 50 <br /> 51 6. Unsuitable Material <br /> 52 Material unsatisfactory for habitat berm placement is defined as unsuitable material. <br /> 111 53 Unsuitable material shall include rocks, boulders, rubble, unnatural debris, trash, <br /> IRIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 105 <br />
