I 1 The bidder adds provisions reserving the right to reject or accept the award, or enter 2 into the contract; 3 A price per unit cannot be determined from the bid proposal; 4 The proposal form is not properly executed; 5 The bidder fails to submit or properly complete a subcontractor list, if applicable, as 6 required in Section 1 02.6. 7 The bidder fails to submit or properly complete a Disadvantaged, Minority or 8 Women's Business Enterprise Certification, if applicable, as required in Section 1- 9 02.6; or I 10 The bid proposal does not constitute a definite and unqualified offer to meet the 11 material terms of the bid invitation. 12 I 13 1-02.15 Pre-Award Information 14 Revise this section to read: 15 I 16 Before awarding any contract, the Contracting Agency may require one or more of these 17 items or actions of the apparent lowest responsible bidder: 18 1. A complete statement of the origin, composition, and manufacture of any or all 19 materials to be used, I20 2. Samples of these materials for quality and fitness tests, 21 3. A progress schedule (in a form the Contracting Agency requires) showing the order I 22 of and time required for the various phases of the work, 23 4. A breakdown of costs assigned to any bid item, 24 5. Attendance at a conference with the Engineer or representatives of the Engineer, I25 6. Obtain, and furnish a copy of, a business license to do business in the city or county 26 where the work is located. 27 7. A copy of State of Washington Contractor's Registration, or 28 8. Any other information or action taken that is deemed necessary to ensure that the 29 bidder is the lowest responsive and responsible bidder. I 30 31 1-03 AWARD AND EXECUTION OF CONTRACT 32 I 33 1-03.1 Consideration of Bids 34 35 The first paragraph is modified to read as follows: 36 After opening and reading proposals, the Contracting Agency will check them for I37 correctness of extensions of the prices per unit and the total price. If a discrepancy 38 exists between the price per unit and the extended amount of any bid item, the price per 39 unit will control. If a minimum bid amount has been established for any item and the II 40 bidder's unit or lump sum price is less than the minimum specified amount, the 41 Contracting Agency will unilaterally revise the unit or lump sum price, to the minimum 42 specified amount and recalculate the extension. The total of extensions, corrected I 43 where necessary, including sales taxes where applicable and such additives and/or 44 alternates as selected by the Contracting Agency, will be used by the Contracting 45 Agency for award purposes and to fix the Awarded Contract Price amount and the 1 46 amount of the contract bond. 47 I 1 RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 15
