I <br /> 1 The bidder adds provisions reserving the right to reject or accept the award, or enter <br /> 2 into the contract; <br /> 3 A price per unit cannot be determined from the bid proposal; <br /> 4 The proposal form is not properly executed; <br /> 5 The bidder fails to submit or properly complete a subcontractor list, if applicable, as <br /> 6 required in Section 1 02.6. <br /> 7 The bidder fails to submit or properly complete a Disadvantaged, Minority or <br /> 8 Women's Business Enterprise Certification, if applicable, as required in Section 1- <br /> 9 02.6; or <br /> I 10 The bid proposal does not constitute a definite and unqualified offer to meet the <br /> 11 material terms of the bid invitation. <br /> 12 <br /> I 13 1-02.15 Pre-Award Information <br /> 14 Revise this section to read: <br /> 15 <br /> I 16 Before awarding any contract, the Contracting Agency may require one or more of these <br /> 17 items or actions of the apparent lowest responsible bidder: <br /> 18 1. A complete statement of the origin, composition, and manufacture of any or all <br /> 19 materials to be used, <br /> I20 2. Samples of these materials for quality and fitness tests, <br /> 21 3. A progress schedule (in a form the Contracting Agency requires) showing the order <br /> I 22 of and time required for the various phases of the work, <br /> 23 4. A breakdown of costs assigned to any bid item, <br /> 24 5. Attendance at a conference with the Engineer or representatives of the Engineer, <br /> I25 6. Obtain, and furnish a copy of, a business license to do business in the city or county <br /> 26 where the work is located. <br /> 27 7. A copy of State of Washington Contractor's Registration, or <br /> 28 8. Any other information or action taken that is deemed necessary to ensure that the <br /> 29 bidder is the lowest responsive and responsible bidder. <br /> I 30 <br /> 31 1-03 AWARD AND EXECUTION OF CONTRACT <br /> 32 <br /> I 33 1-03.1 Consideration of Bids <br /> 34 <br /> 35 The first paragraph is modified to read as follows: <br /> 36 After opening and reading proposals, the Contracting Agency will check them for <br /> I37 correctness of extensions of the prices per unit and the total price. If a discrepancy <br /> 38 exists between the price per unit and the extended amount of any bid item, the price per <br /> 39 unit will control. If a minimum bid amount has been established for any item and the <br /> II 40 bidder's unit or lump sum price is less than the minimum specified amount, the <br /> 41 Contracting Agency will unilaterally revise the unit or lump sum price, to the minimum <br /> 42 specified amount and recalculate the extension. The total of extensions, corrected <br /> I 43 where necessary, including sales taxes where applicable and such additives and/or <br /> 44 alternates as selected by the Contracting Agency, will be used by the Contracting <br /> 45 Agency for award purposes and to fix the Awarded Contract Price amount and the <br /> 1 46 amount of the contract bond. <br /> 47 <br /> I <br /> 1 RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 15 <br />
