I <br /> 1 1-03.3 Execution of Contract <br /> 2 <br /> 3 Section 1-03.3 is amended by adding the following: <br /> 4 The Contractor is required to possess a City business license prior to award. <br /> 5 1 6 The successful Contractor shall obtain two (2) copies of the contract provisions from the <br /> 7 City Engineer after the project has been awarded by City Council. These documents will <br /> 8 have been prepared by the City Clerk, Sharon Fuller (257-8610) for execution of the <br /> 9 contract. The Contractor shall promptly execute and return both signed copies of the <br /> 10 prepared contract together with an insurance certificate and additional insured <br /> 11 endorsement as required by Section 1-07.18 and a satisfactory bond as required by law <br /> 12 and Section 1-03.4. The City will forward 1 copy of the fully executed contract to the <br /> 13 Contractor for its records and the City will retain the other. A bid shall not be binding on <br /> 14 the City until the contract has been fully executed by the City. <br /> 15 <br /> 16 1-03.4 Contract Bond <br /> 17 <br /> 18 Supplement the first paragraph with the following: <br /> 19 5. Be accompanied by a power of attorney for the Surety's officer empowered to <br /> 20 sign the bond; and <br /> 21 6. Be signed by an officer of the Contractor empowered to sign official statements <br /> 22 (sole proprietor or partner). If the Contractor is a corporation, the bond must be <br /> 23 signed by the president or vice-president, unless accompanied by written proof of <br /> 24 the authority of the individual signing the bond to bind the corporation (i.e., 111 <br /> 25 corporate resolution, power of attorney or a letter to such effect by the president <br /> 26 or vice-president). <br /> 27 1 28 1-03.7 Judicial Review <br /> 29 <br /> 30 Section 1-0.7 is modified to read as follows: <br /> 31 Any decision made by the Contracting Agency regarding the award and execution of the <br /> 32 contract or bid rejection shall be conclusive subject to the scope of judicial review <br /> 33 permitted under Washington Law. Such review, if any, shall be timely filed in the <br /> II <br /> 34 Superior Court of Snohomish County. <br /> 35 <br /> 36 1-04 SCOPE OF THE WORK I <br /> 37 <br /> 38 1-04.2 Coordination of Contract Documents, Plans, Special Provisions <br /> 39 Specifications, and Addenda <br /> 40 <br /> 41 Section 1-04.2 is modified to read as follows: <br /> 42 Any inconsistency in the parts of the contract shall be resolved by following this order of <br /> 43 precedence (e.g., 1 presiding over 2, 2 over 3, 3 over 4, and so forth): 11 <br /> 44 1.
