I 1 by Contractor's failure to submit required information in sufficient time for review, 2 comment, and correction. Contractor's failure to submit required information in sufficient 3 time for review, comment and correction shall be deemed a waiver of any and all 4 Contract Claims for adjustment of Contract Sum or Contract Time arising out of, or 5 related to, such a Submittal. Contractor acknowledges and agrees that it may not rely 6 upon receiving the Owner's response to a Submittal in less than ten (10) working days, 7 unless the Owner explicitly changes this section by a signed Change Order. 8 9 1-05.3A(2) Requests for Information 10 11 Requests for information or clarification from the Contractor to the Owner shall be 12 treated as a Submittal pursuant to section 1-05.3A(1) Submittals. 13 14 1-05.4 Conformity With and Deviations From Plans and Stakes 15 16 Section 1-05.4 is modified to read as follows: 17 18 The Contractor shall be responsible for setting and maintaining all alignment stakes, 19 slope stakes, and grades necessary for the construction of the roadbed, surfacing, 20 paving, channelization, illumination, signing, bridges, and retaining walls, if such 21 construction is included in this project. Except for the survey control data to be furnished 22 by the City, calculations, surveying, and measuring required for setting and maintaining 23 the necessary lines and grades shall be the Contractor's responsibility. The Contractor 24 shall provide the City with copies of such calculations and staking data when requested 1 25 by the Engineer. Copies of the City provided survey control data are available for the 26 bidder's inspection at the office of the Project Engineer. 27 28 Any staking requirements for the project that do not fit field conditions will be reviewed 29 and if necessary adjusted by the Engineer. Any necessary revision to the staking 30 information will be provided to the Contractor for use in completing the work. 31 32 Stakes, marks, and other reference points, including existing monumentation, set by the 33 City shall be carefully preserved by the Contractor. The Contractor will be charged for 34 the costs of replacing stakes, markers and monumentation that were not to be disturbed 35 but were destroyed or damaged by the Contractor's operations. This charge will be 36 deducted from monies due or to become due to the Contractor. 37 38 To facilitate the establishment of these lines and elevations, the City will provide the 39 Contractor with the following survey control: 40 41 ROADWAY, SURFACING AND PAVING 42 1. Establish elevation bench marks and center or base line alignment control points 43 for the mainline, one time only. Provide right of way stakes where applicable. 44 2. Provide rights-of-way, easements or right-of-entry. 45 3. Provide the Contractor with technical advice if requested. 46 4. Computed grades where needed. 47 5. Horizontal and vertical curve detections. 48 6. One copy of transit notes showing reference to horizontal and vertical control 49 points. 50 BRIDGES AND OTHER STRUCTURES 51 1.
