I <br /> 1 by Contractor's failure to submit required information in sufficient time for review, <br /> 2 comment, and correction. Contractor's failure to submit required information in sufficient <br /> 3 time for review, comment and correction shall be deemed a waiver of any and all <br /> 4 Contract Claims for adjustment of Contract Sum or Contract Time arising out of, or <br /> 5 related to, such a Submittal. Contractor acknowledges and agrees that it may not rely <br /> 6 upon receiving the Owner's response to a Submittal in less than ten (10) working days, <br /> 7 unless the Owner explicitly changes this section by a signed Change Order. <br /> 8 <br /> 9 1-05.3A(2) Requests for Information <br /> 10 <br /> 11 Requests for information or clarification from the Contractor to the Owner shall be <br /> 12 treated as a Submittal pursuant to section 1-05.3A(1) Submittals. <br /> 13 <br /> 14 1-05.4 Conformity With and Deviations From Plans and Stakes <br /> 15 <br /> 16 Section 1-05.4 is modified to read as follows: <br /> 17 <br /> 18 The Contractor shall be responsible for setting and maintaining all alignment stakes, <br /> 19 slope stakes, and grades necessary for the construction of the roadbed, surfacing, <br /> 20 paving, channelization, illumination, signing, bridges, and retaining walls, if such <br /> 21 construction is included in this project. Except for the survey control data to be furnished <br /> 22 by the City, calculations, surveying, and measuring required for setting and maintaining <br /> 23 the necessary lines and grades shall be the Contractor's responsibility. The Contractor <br /> 24 shall provide the City with copies of such calculations and staking data when requested 1 <br /> 25 by the Engineer. Copies of the City provided survey control data are available for the <br /> 26 bidder's inspection at the office of the Project Engineer. <br /> 27 <br /> 28 Any staking requirements for the project that do not fit field conditions will be reviewed <br /> 29 and if necessary adjusted by the Engineer. Any necessary revision to the staking <br /> 30 information will be provided to the Contractor for use in completing the work. <br /> 31 <br /> 32 Stakes, marks, and other reference points, including existing monumentation, set by the <br /> 33 City shall be carefully preserved by the Contractor. The Contractor will be charged for <br /> 34 the costs of replacing stakes, markers and monumentation that were not to be disturbed <br /> 35 but were destroyed or damaged by the Contractor's operations. This charge will be <br /> 36 deducted from monies due or to become due to the Contractor. <br /> 37 <br /> 38 To facilitate the establishment of these lines and elevations, the City will provide the <br /> 39 Contractor with the following survey control: <br /> 40 <br /> 41 ROADWAY, SURFACING AND PAVING <br /> 42 1. Establish elevation bench marks and center or base line alignment control points <br /> 43 for the mainline, one time only. Provide right of way stakes where applicable. <br /> 44 2. Provide rights-of-way, easements or right-of-entry. <br /> 45 3. Provide the Contractor with technical advice if requested. <br /> 46 4. Computed grades where needed. <br /> 47 5. Horizontal and vertical curve detections. <br /> 48 6. One copy of transit notes showing reference to horizontal and vertical control <br /> 49 points. <br /> 50 BRIDGES AND OTHER STRUCTURES <br /> 51 1. Centerline or offsets to centerline of the structure. <br /> 52 2. Stations of abutments and pier centerlines. <br /> RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 28 <br />
