I <br /> 1 1-05.18(3)(E) Safety <br /> I 2 The Contractor alone shall be responsible for safety on the job site, including, but not <br /> 3 limited to, the safety of its and its subcontractor's employees. The Contractor shall <br /> 4 maintain the Project site and perform the work in a manner which meets the Owner's <br /> 111 5 <br /> 6 responsibility under statutory and common law for the provision of a safe place to work. <br /> 7 1-05.18(3)(F) Threats, Intimidation and Harassment Forbidden <br /> I 8 Contractor shall not allow its employees, its subcontractors, its subcontractors' <br /> 9 employees, or any other agents to threaten bodily injury or property damage, to <br /> 10 intimidate or attempt to intimidate any person, or to assault or physically harass any <br /> 11 person. Forbidden conduct includes, but is not limited to, threatening, appearing, or <br /> 12 actually doing any of the following: pushing, shoving, striking, physically blocking a <br /> 13 person or a person's vehicle, vandalism, malicious mischief, or any other act that a <br /> I 14 reasonable person would understand be intended to intimidate, cause personal injury, or <br /> 15 cause property damage. Contractor shall remove from the job site any person <br /> 16 reasonably under its control or direction who the Contractor or Owner reasonably <br /> 17 believes violated this section. The lack of a request from the Owner or Owner's <br /> 18 Representative to the Contractor to remove someone from the job site does not relieve <br /> 19 the Contractor from its obligation to remove someone. <br /> 20 <br /> I 21 1-05.18(3)(G) Weapons Forbidden <br /> 22 Contractor shall not allow its employees, its subcontractors, its subcontractors' <br /> 23 employees, or any other agents or representatives to carry or possess, openly or <br /> I 24 concealed, explosives or weapons on the job site, except: (a) such explosives are as <br /> 25 reasonably required for performance of the Work, such as those necessary for blasting <br /> 26 or demolition work called for by the Contract Documents or (b) commissioned law <br /> 27 enforcement officers or security personnel under authority of their commission. A <br /> I 28 weapon is any object, instrument or chemical which is (1) designed in such a manner to <br /> 29 inflict harm or injury to another person; or(2) any item used in a manner threatening <br /> 30 harm or injury to another person. Weapons include, but are not limited to, firearms, <br /> I 31 dangerous knives, dangerous chemicals, tear gas, martial arts weapons, blackjacks or <br /> 32 other weapons. Further, weapons should include those described EMC Chapter 10.78. <br /> 33 Possession of mace, pepper spray or the like for defensive purposes is not a violation of <br /> 34 this policy. Contractor shall remove from the job site any person reasonably under its <br /> 35 control or direction who the Contractor or Owner reasonably believes violated this <br /> 36 section. The lack of a request from the Owner or Owner's Representative to the <br /> I 37 Contractor to remove someone from the job site does not relieve the Contractor from its <br /> 38 obligation to remove someone. <br /> 39 <br /> I 40 1-05.18(3)(H) Safety Standards <br /> 41 The Contractor shall comply with Section 107 of the Contract Work Hours and Safety <br /> 42 Standards Act (40 U.S.C. 327-330) as supplemented by Department of Labor <br /> 43 Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not require any <br /> I 44 laborer or mechanic to work in surroundings or under working conditions that are <br /> 45 unsanitary, hazardous, or dangerous to its health and safety as determined under <br /> 46 construction, safety, and health standards promulgated by the Secretary of Labor. <br /> 47 These requirements do not apply to the purchase of supplies or materials or articles <br /> 48 ordinarily available on the open market, or contracts for transportation or transmission of <br /> 49 intelligence. <br /> I 50 <br /> 51 1-05.18(3)(1) Public Safety and Convenience <br /> 52 The Contractor shall conduct its work so as to ensure the least possible obstruction to <br /> I53 traffic and inconvenience to the general public, business, organizations and residents in <br /> 1 RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 37 <br />
