1 1-05.18(3)(E) Safety
I 2 The Contractor alone shall be responsible for safety on the job site, including, but not
3 limited to, the safety of its and its subcontractor's employees. The Contractor shall
4 maintain the Project site and perform the work in a manner which meets the Owner's
111 5
6 responsibility under statutory and common law for the provision of a safe place to work.
7 1-05.18(3)(F) Threats, Intimidation and Harassment Forbidden
I 8 Contractor shall not allow its employees, its subcontractors, its subcontractors'
9 employees, or any other agents to threaten bodily injury or property damage, to
10 intimidate or attempt to intimidate any person, or to assault or physically harass any
11 person. Forbidden conduct includes, but is not limited to, threatening, appearing, or
12 actually doing any of the following: pushing, shoving, striking, physically blocking a
13 person or a person's vehicle, vandalism, malicious mischief, or any other act that a
I 14 reasonable person would understand be intended to intimidate, cause personal injury, or
15 cause property damage. Contractor shall remove from the job site any person
16 reasonably under its control or direction who the Contractor or Owner reasonably
17 believes violated this section. The lack of a request from the Owner or Owner's
18 Representative to the Contractor to remove someone from the job site does not relieve
19 the Contractor from its obligation to remove someone.
20
I 21 1-05.18(3)(G) Weapons Forbidden
22 Contractor shall not allow its employees, its subcontractors, its subcontractors'
23 employees, or any other agents or representatives to carry or possess, openly or
I 24 concealed, explosives or weapons on the job site, except: (a) such explosives are as
25 reasonably required for performance of the Work, such as those necessary for blasting
26 or demolition work called for by the Contract Documents or (b) commissioned law
27 enforcement officers or security personnel under authority of their commission. A
I 28 weapon is any object, instrument or chemical which is (1) designed in such a manner to
29 inflict harm or injury to another person; or(2) any item used in a manner threatening
30 harm or injury to another person. Weapons include, but are not limited to, firearms,
I 31 dangerous knives, dangerous chemicals, tear gas, martial arts weapons, blackjacks or
32 other weapons. Further, weapons should include those described EMC Chapter 10.78.
33 Possession of mace, pepper spray or the like for defensive purposes is not a violation of
34 this policy. Contractor shall remove from the job site any person reasonably under its
35 control or direction who the Contractor or Owner reasonably believes violated this
36 section. The lack of a request from the Owner or Owner's Representative to the
I 37 Contractor to remove someone from the job site does not relieve the Contractor from its
38 obligation to remove someone.
39
I 40 1-05.18(3)(H) Safety Standards
41 The Contractor shall comply with Section 107 of the Contract Work Hours and Safety
42 Standards Act (40 U.S.C. 327-330) as supplemented by Department of Labor
43 Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not require any
I 44 laborer or mechanic to work in surroundings or under working conditions that are
45 unsanitary, hazardous, or dangerous to its health and safety as determined under
46 construction, safety, and health standards promulgated by the Secretary of Labor.
47 These requirements do not apply to the purchase of supplies or materials or articles
48 ordinarily available on the open market, or contracts for transportation or transmission of
49 intelligence.
