I <br /> 1 1-07.18(5)G Pollution Liability <br /> 2 The Contractor shall provide a Pollution Liability policy, providing coverage for claims <br /> 3 involving bodily injury, property damage (including loss of use of tangible property that <br /> 4 has not been physically injured), cleanup costs, remediation, disposal or other handling <br /> 5 of pollutants, including costs and expenses incurred in the investigation, defense, or <br /> 6 settlement of claims arising out of: <br /> 7 • Contractor's operations related to this project; and/or <br /> 8 • Remediation, abatement, repair, maintenance or other work with lead-based <br /> 9 paint or materials containing asbestos; and/or <br /> 10 • Transportation of hazardous materials away from any site related to this project. <br /> 11 Such Pollution Liability policy shall provide the following minimum coverage: <br /> $2,000,000 each loss and annual aggregate <br /> 12 1-07.18(5)H Professional LiabilityI <br /> 13 The Contractor and/or its Subcontractor and/or its design consultant providing <br /> 14 construction management, value engineering, or any other design-related non- <br /> 15 construction professional services shall provide evidence of Professional LiabilityIII <br /> 16 insurance covering professional errors and omissions. Such policy must provide the <br /> 17 following minimum limits: <br /> $2,000,000 per Claim <br /> 18 <br /> 19 If the scope of such design-related professional services includes work related to <br /> 20 pollution conditions, the Professional Liability insurance shall include Pollution Liability <br /> 21 coverage. <br /> 22 <br /> 23 If insurance is on a claims made form, its retroactive date, and that of all subsequent <br /> 24 renewals, shall be no later than the effective date of this Contract. <br /> 25 <br /> 26 1-07.23 Public Convenience and Safety <br /> 27 <br /> 28 1-07.23(1) Construction Under Traffic <br /> 29 <br /> 30 Section 1-07.23(1) is modified to read as follows: <br /> 31 <br /> 32 The Contractor shall conduct all operations with the least possible obstruction <br /> 33 and inconvenience to the public. The Contractor shall have under construction no <br /> 34 greater length or amount of work than can be prosecuted properly with due <br /> 35 regards to the rights of the public. To the extent possible, the Contractor shall <br /> 36 finish each section before beginning work on the next. <br /> 37 <br /> 38 To disrupt public traffic as little as possible, the Contractor shall permit traffic to pass <br /> 39 through the work with the least possible inconvenience or delay. The Contractor shall I <br /> 40 maintain existing roads and streets within the project limits, keeping them open, and in <br /> 41 good, clean, safe condition at all times. Deficiencies caused by the Contractor's <br /> 42 operations shall be repaired at the Contractor's expense. Deficiencies not caused by the <br /> 43 Contractor's operations shall be repaired by the Contractor when directed by the <br /> 44 Engineer, at the Contracting Agency's expense. The Contractor shall also maintain <br /> 45 roads and streets adjacent to the project limits when affected by the Contractor's <br /> 46 operations. Snow and ice control will be performed by the Contracting Agency on all <br /> 47 projects. Cleanup of snow and ice control debris will be at the Contracting Agency's <br /> 48 expense.
