I <br /> CITY OF EVERETT PUBLIC WORKS DOCUMENT 00 73 13 <br /> SPECIAL PROVISIONS SUPPLEMENTARY CONDITIONS <br /> submitted via a secure website process,but once submitted, are no longer property of the <br /> PORT. <br /> B. (Subparagraph 4.20)TWIC Requirements at the Marine Terminal Facilities <br /> 1. Work for this project will be performed in a restricted area of the Port. In accordance <br /> with Department of Homeland Security federal requirements, Transportation Worker <br /> Identification Credentials (TWIC) will be required for all personnel of the Contractor, <br /> subcontractors, suppliers, and other persons that need to access this restricted area. The <br /> ability of the Contractor to meet and maintain TWIC compliance will be a condition of <br /> the contract. Failure to meet or maintain TWIC compliance for the duration of the <br /> project will result in non-award or cancellation of the contract. <br /> 2. TWIC cardholders will be required to have their TWIC cards with them and available at <br /> all times. Federal regulations allow persons without a TWIC card to enter the restricted <br /> area only with an approved TWIC-cardholding escort. TWIC escorts must be approved <br /> by the Facility Security Officer, must hold a valid TWIC card, must be trained for this <br /> facility, and may only escort up to five (5) individuals. The Contractor will be <br /> responsible for ensuring TWIC compliance by its employees, subcontractors, suppliers, <br /> and any other persons the Contractor contracts with for this project. The Port of Everett <br /> will not provide escort for non-TWIC cardholders. <br /> 3. Contractors should allow between 2 - 12 weeks after application at an enrollment center <br /> for the security threat assessment and issuance of TWIC. TWIC processing time is <br /> dependent on Department of Homeland Security backlog. <br /> 4. Procedure for TWIC Issuance <br /> a. Pre-enroll at https://universalenroll.dhs.gov to enter all of the applicants basic in- <br /> formation and make an appointment at an enrollment center to complete the pro- <br /> cess(although appointments are not required). <br /> b. Applicants must then visit an enrollment center where they will pay the enroll- <br /> ment fee and complete the TWIC application process.The applicant must bring <br /> identity verification documents to enrollment and,in case of aliens,immigration <br /> documents that verify their immigration status,so that the documents can be <br /> scanned into the electronic enrollment record. I <br /> 1.4 (ARTICLE 15)LIABILITY AND INSURANCE <br /> A. (Subparagraph 15.3)Insurance I <br /> Add the following subparagraph <br /> 1. Longshore and Harborworker's Insurance. <br /> It is the Contractor's sole responsibility to determine if U.S. Longshore and <br /> Harborworker's insurance is applicable to Contractor's performance of the Work and to <br /> purchase the appropriate insurance. Contractor will hold the City and the Port harmless <br /> and indemnify the City and the Port for any costs or expenses it incurs due to Contractors <br /> negligent failure to procure the appropriate insurance,including,without limitation,U.S. <br /> Longshore and Harborworker's insurance.This Supplementary Condition shall survive <br /> termination of the Contract. <br /> PSO6 REROUTE 007313 -2 <br /> WO NO.—UP3583 MAY 2016 <br />
