I <br /> CITY OF EVERETT PUBLIC WORKS DOCUMENT 00 73 13 <br /> SPECIAL PROVISIONS SUPPLEMENTARY CONDITIONS <br /> 1.5 (ARTICLE 18)MISCELLANEOUS <br /> Add following Subparagraphs: <br /> Reports of Investigations and Tests <br /> A. General: Information and data reflected in the Contract Documents with respect to underground <br /> conditions and facilities at or contiguous to the site is based upon information and data <br /> furnished to the Owner and the Engineer by owners of such underground facilities or others,and <br /> the Owner does not assume responsibility for the accuracy or completeness thereof. <br /> B. Subsurface Information: <br /> 1. Data on soil and subsurface conditions presented in the Specifications are not to be taken as <br /> definitive but are based on limited available information and the interpretation and opinions of <br /> the investigators; consequently, such data cannot be considered precise or complete, and the <br /> Owner makes no guarantee as to the completeness,accuracy, or precision of the data. <br /> 2. Contractor shall familiarize itself with available information on subsurface conditions that <br /> could be expected to affect the performance of the Work or its schedule and costs associated <br /> with such performance. Reports of studies and investigations and other data obtained by, or on <br /> behalf of, Owner are available to Contractor for its use in developing an understanding of <br /> subsurface conditions. Contractor shall estimate the effect of known site conditions on the <br /> selection of construction equipment and methods, schedule, and costs of performing the Work <br /> under this Contract. <br /> 3. The following geotechnical engineering report was prepared for this project: <br /> a. Geotechnical Engineering Report, PSO6 Reroute, Everett, Washington, Shannon & <br /> ' Wilson,April 22,2016. <br /> The report is included in Appendix A of the project manual. <br /> 4.The information presented in the above documents depicts subsurface conditions at the <br /> exploration locations at the time of exploration. These diagrams are presented only for the <br /> convenience of the Contractor, and their presentation does not reduce or in any way limit the <br /> Contractor's responsibilities noted elsewhere in this section and in the Contract Documents. <br /> Entering into the Contract shall be conclusive evidence that the Contractor has reviewed <br /> available information on site conditions and is satisfied as to the nature of the Work to be <br /> performed,materials to be furnished,and the requirements of the Specifications <br /> C. If desired, Contractor may seek approval from the Owner to make its own subsurface <br /> investigations to satisfy itself of the site and subsurface conditions and to provide information <br /> for Contractor-furnished engineering and drawings. If such investigations are conducted, they <br /> shall be coordinated with the Engineer.
