I <br /> POLICE HQ—MASONRY CLEANING AND REPAIR APRIL 15, 2016 <br /> I <br /> (c) State Requirements. If applicable: <br /> (i) Have Industrial Insurance(workers' compensation) coverage for <br /> the bidder's employees working in Washington, as required in <br /> Title 51 RCW; <br /> (ii) Have a Washington Employment Security Department number, as <br /> required in Title 50 RCW; <br /> (iii) Have a Washington Department of Revenue state excise tax <br /> registration number, as required in Title 82 RCW; and <br /> (d) Disqualification. Not be disqualified from bidding on any public works <br /> contract under RCW 39.06.010 or 39.12.065(3). <br /> (e) Apprentices. If the Project is subject to the apprenticeship utilization <br /> requirements in RCW 39.04.320, not have been found out of compliance <br /> by the Washington state apprenticeship and training council for working <br /> apprentices out of ratio, without appropriate supervision, or outside their <br /> approved work processes as outlined in their standards of apprenticeship <br /> under chapter 49.04 RCW for the one-year period immediately preceding <br /> the date of the bid solicitation. <br /> (f) Off-Site Pre-Fabricated Items. Not have violated RCW 39.04.370 more <br /> than one time as determined by the Department of Labor and Industries. <br /> (2) Supplemental Bidder Responsibility Criteria: RCW 39.04.350(2). If this Project <br /> is subject to supplemental bidder responsibility criteria,then such criteria will be <br /> contained in SECTION 002213, SUPPLEMENTAL INSTRUCTIONS TO <br /> BIDDERS. If there is no SECTION 002213, SUPPLEMENTAL <br /> INSTRUCTIONS TO BIDDERS in the bid package, then the Project is not <br /> subject to supplemental bidder responsibility criteria. <br /> d. BID PROTESTS: All protests by Bidders must be in accordance with Everett <br /> Municipal Code 3.46, "Bid Protest Procedures." <br /> B. PRE-AWARD CONFERENCE <br /> After Bid opening, but prior to award,the apparent successful Bidder shall, if requested by <br /> the City, attend a pre-award conference to respond to questions by the City regarding <br /> evaluation of Bids. The City will emphasize items such as insurance and bonding that will <br /> assist in prompt issuance of the Notice to proceed. By conducting a pre-award conference, <br /> the City has not thereby waived its right to make determinations regarding responsiveness <br /> and responsibility of the Bidder. <br /> C. ACCEPTANCE OF BID <br /> 1. Within 60days after the opening of Bids,the City will act either to accept the Bid from <br /> the lowest responsive, responsible Bidder, or to reject all Bids. The City reserves the <br /> right to request extensions of such Bid acceptance period. The acceptance of a Bid will <br /> be evidenced by a written Notice of Award of Contract delivered in person or by certified <br /> mail to the Bidder whose Bid is accepted, together with a request to furnish a <br /> performance and payment bond and evidence of insurance and to execute the Contract set <br /> forth in the Contract Documents. <br /> 2.
