I <br /> POLICE HQ—MASONRY CLEANING AND REPAIR APRIL 15, 2016 <br /> r <br /> 1.7 Bidder's Signature and Authority <br /> If the Bid is made by an individual,his or her name, signature, and post office address must be <br /> shown; if made by a firm or partnership, the name and post office address of the firm or <br /> partnership, a list of the partners, and the signature of at least one of the general partners must be <br /> shown; if made by a corporation, the Bid shall show the name of the state under the laws of <br /> which the corporation is chartered, the name and post office address of the corporation, and the <br /> title of the person who signs on behalf of the corporation. If the Bid is made by a joint venture, <br /> the Bid shall be signed by a representative of one of the joint venture firms. Additionally,the <br /> Bid shall include a copy of the resolution or agreement empowering the representative to execute <br /> the Bid and bind the joint venture. <br /> 1.8 Revision or Withdrawal of Bid <br /> A. A Bid may be revised and resubmitted as the official Bid if the City receives the revised bid <br /> before the scheduled time for opening Bids. Resubmitted Bids shall be in full compliance <br /> with these Instructions to Bidders. Bid security shall be in an amount sufficient for the Bid <br /> as resubmitted. <br /> B. After the scheduled time for opening Bids,no Bidder will be permitted to withdraw his Bid <br /> unless the award of contract is delayed for a period exceeding 60 calendar days Bids received <br /> after the scheduled closing for opening Bids shall be returned to the Bidder unopened. <br /> C. Within 5 days after the opening of Bids, a Bidder who wishes to claim error after the Bids <br /> have been opened and tabulated shall submit a notarized affidavit signed by the Bidder, <br /> accompanied by original work sheets used in the preparation of the Bid,requesting relief <br /> from the responsibilities of award. The affidavit shall describe the specific error(s) and <br /> certify that the work sheets are the originals used in the preparation of the Bid. City staff will <br /> review the certified work sheets to determine the validity of the claimed error and make a <br /> recommendation. If the City concurs in the claim of error, the Bidder will be relieved of <br /> responsibility, and the bid security of the Bidder will be returned. Thereafter, at the <br /> discretion of the City, all Bids may be rejected or award made to next lowest and responsive <br /> Bidder. At the discretion of the City, Bidders claiming error may or may not be allowed to <br /> participate in the re-bid. <br /> 1 1.9 Bid Security <br /> A. Bid Security in the amount of at least 5 percent of the Total Bid Amount shall accompany <br /> each Bid. This security may be by certified check, cashier's check, or a bid bond made <br /> payable to the City of Everett. A bid bond shall be on the form provided in the Contract <br /> Documents. A bid bond shall not be conditioned to modify the minimum 5-percent required. <br /> The surety shall: (1)be registered with the Washington State Insurance Commissioner, and <br /> (2) appear on the current Authorized Insurance List in the State of Washington published by <br /> the Office of the Insurance Commissioner. <br /> B. The failure to furnish a bid security of a minimum of 5 percent shall make the Bid <br /> nonresponsive and shall cause the Bid to be rejected by the City of Everett. <br /> C. Bid security shall serve as evidence of good faith and as a guarantee that if awarded the <br /> Contract the Bidder will execute the Contract and provide bonds as required by the Bid. <br /> Should the successful Bidder fail to enter into the Contract, furnish a satisfactory <br /> performance and payment bond, and furnish evidence of insurance within 14 calendar days <br /> INSTRUCTIONS TO BIDDERS 00 2113 -3 <br />
