4. The City Council of Everett recognizes, respects and wishes to support the elected public <br /> officials of the Port of Everett Commission (the Commissioners) in their visionary call for the <br /> conversion of the North Marina Property to more desirable and popular(according to public <br /> input) public access-friendly uses including new walkway links, expanded shoreline access and <br /> more commercial enterprise proposed by the Port in this area. <br /> 5. In order for the City Council to respond to and support the preceding findings the <br /> Shoreline Master Program shall be amended in the areas listed below. It must be made clear <br /> however that the changes to policy and regulatory provisions of the SMP made herein are to be <br /> made for and on the subject area only and shall affect no other part or portion of the shoreline <br /> jurisdiction area. <br /> 6. The subject areas of the changes made herein are as follows: <br /> a. The SMP Vision Statement(page 4-7 - Section 4.4 Urban Maritime) calls for <br /> this area to be "working waterfront." This vision statement will be amended to allow a wider <br /> range of uses while still allowing marina support activities to continue to thrive. <br /> b. The Management Policies on page 4-8, policy # 1 of the SMP says, "this area <br /> should be used for maritime uses and services, and encourage a mix of compatible water- <br /> dependent and associated water-related industrial and recreational uses and water-oriented <br /> commercial uses." This section will be modified to add non-water related and non-water <br /> dependent uses to be allowed inside the SMP jurisdictional area in the subject area. <br /> c. The Shoreline Use Table 5.1 on page 5-2 of the SMP says "non-water oriented <br /> uses" are not allowed, as denoted by the "X" under the "Maritime zone." This regulation will be <br /> amended to allow such uses in the subject area. <br /> 7. It is not anticipated or expected that the Port will expand the proposal beyond those <br /> properties identified in this proposal. <br /> 8. The Planning Commission has successful encouraged the Port, Maritime Trust and <br /> affected nearby residential and business property owners to enter into dialogue and reach <br /> compromises, reflected in the Planning Commission Resolution, which seek to reduce and <br /> mitigate vicinity impacts. <br /> NOW, THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: That the City Council hereby adopts in accordance with the State of Washington <br /> Shoreline Management Act the updated Shoreline Master Program as set forth in Section 2. <br /> SECTION 2: That the City Council hereby amends Ordinance No. 2600-02 (the Shoreline <br /> Master Program), by changing the following text: <br />
