It is the specific intent of this Code to place the obligation of complying with its <br /> requirements upon the permit applicant and any person owning, operating or <br /> controlling any building or structure within its scope and no provision nor term <br /> used in this Code is intended to impose any duty whatsoever upon the City or any <br /> of its officers or employees for whom the implementation or enforcement of this <br /> Code shall be discretionary and not mandatory. <br /> Nothing contained in this Code is intended to be nor shall be construed to create or <br /> form this basis for any liability on the part of this City or it officers, employees or <br /> agents, for any injury or damage resulting from the failure of a building to comply <br /> with the provisions of this Code, or be reason or consequence of any inspection, <br /> notice, order certificate, permission or approval authorized or issued or done in <br /> connection with the implementation or enforcement of this Code, or by reason of <br /> any action of the City related in any manner to the enforcement of this Code by its <br /> officers, employees or agents. <br /> Notwithstanding any language used in this Code, it is not the intent of this code to <br /> create a duty and/or cause of action running to any individual or identifiable person <br /> but rather any duty is intended to run only to the general public. <br /> D. Section 101.4.1 of the 2003 Edition of the IBC - Electrical. The National Electrical <br /> Code as adopted by the City of Everett, Chapter 16.05, shall apply to the <br /> installation of electrical systems, including alterations, repairs, replacement, <br /> equipment, appliances, fixtures, fittings and appurtenances thereto. <br /> E. Section 101.4.4 of the 2003 Edition of the IBC - Plumbing. The provisions of the <br /> Uniform Plumbing Code as adopted by the City of Everett Chapter 16.04 shall <br /> apply to the installation, alteration, repair and replacement of plumbing systems, <br /> including equipment, appliances, fixtures, fittings and appurtenances, and where <br /> connected to a water or sewage system and all aspects of a medical gas system. <br /> The provisions of the State of Washington requirements for private sewage disposal <br /> shall apply to private sewage disposal systems. <br /> F. Section 101.4.5 of the 2003 Edition of the IBC - Property Maintenance. "Delete" <br /> G. Section 101.4.7 of the 2003 Edition of the IBC - Energy. The provisions of the <br /> State of Washington Energy Code adopted by the City of Everett and the State of <br /> Washington Ventilation and Indoor Air Quality Code adopted by the City of <br /> Everett Chapter 16.10 shall apply to all matters governing the design and <br /> construction of buildings for energy efficiency. <br /> H. Section 102.6 of the 2003 Edition of the IBC - Existing Structures. Delete "The <br /> International Property Maintenance Code or". <br /> I. Section 102.7 of the 2003 Edition of the IRC - Existing Structures. Delete "The <br /> International property Maintenance Code or". <br /> 2 <br /> DEDI/ORDINANCE/INPL BLDG CODE <br />
