SECTION 4: Shoreline Environment Designation for Marshlands <br /> Section 4 of the Shoreline Master Program, Exhibit A to Ordinance No. 2600-02, as amended, <br /> and Section III of the Shoreline Land Use Element of the Comprehensive Plan, are hereby <br /> amended by the addition of the following: <br /> 4.15 Urban Conservancy Agriculture Interim <br /> Purpose <br /> To provide an interim designation for the Marshlands, a shoreline area that has been identified as <br /> having significant tidal restoration potential and that is characterized by diverse property <br /> ownership, and floodplains/floodways that have been altered by diking, agricultural activities, <br /> transportation facilities, and utility corridors. The interim designation will allow the City, in <br /> cooperation with property owners, Ecology, scientists, interested agencies/organizations, and <br /> members of the public, to conduct special area planning for the Marshlands. This planning will <br /> commence when funding is available and this interim designation shall remain in place and <br /> effect until completion of the subarea planning process, delivery of the final subarea plan to the <br /> City of Everett City Council, and adoption of a new designation for the Marshlands that <br /> recognizes restoration opportunities identified in the final subarea plan, as required by the <br /> agreement settling the City of Everett, et al. v. CPSGMHB litigation (Division One Court of <br /> Appeals Case Numbers 52262-1-I & 52276-1-I). <br /> Area Designated—Urban Conservancy Agriculture Interim <br /> All that portion of the Marshlands area within the Everett City limits located south of the north <br /> boundary of Lowell Snohomish River Road and east of Lowell Larimer Road, except for those <br /> properties specifically designated Urban Conservancy and Shoreline Residential. <br /> Management Policies <br /> 1. The subarea planning process will result in a subarea plan and/or shoreline use <br /> regulations that will be incorporated into the City's comprehensive plan, including the <br /> Shoreline Master Program and zoning code as applicable. <br /> 2. Public access should be encouraged. <br /> 3. Agriculture and associated industry, forest practices, and transportation and utility <br /> facilities are permitted. <br /> 4. New construction of structures in the floodplain areas should be limited to structures with <br /> low flood damage potential. When development is allowed within floodplain areas, <br /> necessary measures shall be taken to protect property from damages that could be caused <br /> by flooding. New development in floodplain areas should reflect the character of the <br /> surrounding area by limiting residential density, providing permanent open space, and <br /> maintaining adequate building setbacks from the water to protect shoreline resources. <br /> 6 <br />
