The a�piication is fer approval of a Special Cse Permit as prescribe� in _ <br /> the Everett tduniczpal Cod2 , Section 19 . 58. 010 (C. 1) and anprovai of a �ar�- <br /> ance as prescribed in the Everett htunicipal Code, Section 19 .70 and Ordin- <br /> ance 692-80, Section 14. The applications are for 9 . 8 acres of land <br /> located at 202 A13er, Everett, tlashington , and riore particularl:� described <br /> as set forth in the introduction of this docu.^.:ent. The above described <br /> land is 2oned R-1, Single-Family Low-Density, F:esidential, as establisned <br /> in the City of Everett D4unicipal Code. <br /> 2. The Hearir.g Examiner of the City of Everett has the authority to hear the <br /> applications for the Special Prooerty Use Permit and the Variance. This <br /> authority is granted the Hearing Examiner in Section 14 of Ordinance 692-80 <br /> of the City of Everett, 47ashington. <br /> 3. Chapter 19. 58 of the Everett Ptunicipal Code establishes the criteria for <br /> allowin, Special ProF�erty Use Permits. <br /> 9. It has been established by testimony of the Applicant and of the Plan�inq <br /> Deoartment that the application for the Special Use Permit meets the criter- <br /> ia of Section 19 . 58.010 of the Everett Municipal Code in that the prcpos- <br /> ed project is reasonably compatible with other uses and potential uses wi.th- <br /> in the general area; that the proposed project does not have serious adverse <br /> ecfects on the ecoloay and environment of the community; and that the oro- <br /> posed project serves the public convenience and is necessary. <br /> 5. In Section 19. 70.060 A & B, the criteria for the qrantinq of a Variance is set <br /> forth. Zt has been proven that the criteria has been met and that the pro- <br /> posed project is an exceptional circumstance that does not generally apply <br /> to ths �*her proaerties in the same vicinity. Further, the Variance is <br /> necessas; `or the oreservation and enjoyment of the property. Also, the <br /> authorization of this Variance would not be detrimental to the <br /> public welfare or injurious to the property and it would not adcersely <br /> affect the Comprehensive General Plan. � <br /> 6. The Variance is necessary to nrovide adequate recreational facilities for � <br /> handicapced students who are going to be served by the expansion of the <br /> View Ridge School. i <br /> 7. The Planning Department of the City of Everett has recom.mended approval �f i <br /> the Special Property Use Permi'_ and the Variance .
