ANIMAL SHELTER AGREEMENT BETWEEN THE CITY OF EVERETT AND THE CITY OF GOLD BAR THIS AGREEMENT is made and entered into this day of 2003 by and between the City of Everett, a political subdivision of the State of Washington ("Everett") and the City of Gold Bar, a political subdivision of the State of Washington ("Gold Bar"), collectively hereinafter referred to as the Parties. WITNESSES THAT: WHEREAS, Gold Bar regulates animals pursuant to Title 6 of the Gold Bar Municipal Code; and WHEREAS, Gold Bar does not have the facilities to shelter, care for, and dispose of animals as specified in the Gold Bar Municipal Code; and WHEREAS, RCW 39.34.010 and 39.34.080 authorize Everett and Gold Bar to contract for the performance of government services such as animal shelter services; and WHEREAS, Everett agrees to render such services based on the terms and conditions set forth below, NOW THEREFORE, in consideration of the mutual covenants, conditions, performances, and promises hereinafter contained, the parties agree as follows: A. SCOPE OF SERVICES AND AUTHORITY 1. The services to be provided by Everett under this agreement shall be limited to animal shelter services for stray animals delivered to Everett's shelter by a City of Gold Bar employee or designee. 2. For purposes of this agreement, the term "animals" shall refer to any member of the classes; reptile, bird, or mammal, except homo sapien. 3. Animal shelter services shall include the following: a. Sheltering and holding animals at facilities operated by Everett, provided that capacity is available at the time of delivery. b. Releasing animals to owners. c. Adoption of animals. d. Disposing of animals, including destruction of animals not claimed by an owner, in accordance with the Gold Bar Municipal Code and the terms of this agreement. e. Disposing of dead animals. 'J 1
