ANIMAL SHELTER AGREEMENT <br /> BETWEEN <br /> THE CITY OF EVERETT <br /> AND THE CITY OF GOLD BAR <br /> THIS AGREEMENT is made and entered into this day of <br /> 2003 by and between the City of Everett, a political subdivision of the State of <br /> Washington ("Everett") and the City of Gold Bar, a political subdivision of the State of <br /> Washington ("Gold Bar"), collectively hereinafter referred to as the Parties. <br /> WITNESSES THAT: <br /> WHEREAS, Gold Bar regulates animals pursuant to Title 6 of the Gold Bar <br /> Municipal Code; and <br /> WHEREAS, Gold Bar does not have the facilities to shelter, care for, and dispose <br /> of animals as specified in the Gold Bar Municipal Code; and <br /> WHEREAS, RCW 39.34.010 and 39.34.080 authorize Everett and Gold Bar to <br /> contract for the performance of government services such as animal shelter services; and <br /> WHEREAS, Everett agrees to render such services based on the terms and <br /> conditions set forth below, <br /> NOW THEREFORE, in consideration of the mutual covenants, conditions, <br /> performances, and promises hereinafter contained, the parties agree as follows: <br /> A. SCOPE OF SERVICES AND AUTHORITY <br /> 1. The services to be provided by Everett under this agreement shall be limited <br /> to animal shelter services for stray animals delivered to Everett's shelter by a <br /> City of Gold Bar employee or designee. <br /> 2. For purposes of this agreement, the term "animals" shall refer to any member <br /> of the classes; reptile, bird, or mammal, except homo sapien. <br /> 3. Animal shelter services shall include the following: <br /> a. Sheltering and holding animals at facilities operated by Everett, <br /> provided that capacity is available at the time of delivery. <br /> b. Releasing animals to owners. <br /> c. Adoption of animals. <br /> d. Disposing of animals, including destruction of animals not claimed by <br /> an owner, in accordance with the Gold Bar Municipal Code and the <br /> terms of this agreement. <br /> e.
