4.6 Project Design and Approvals <br /> Design Development Approvals <br /> During the period prior to the submittal of a development application to the City, <br /> the City agrees, to the extent allowed by law,to review and comment <br /> expeditiously on the Project to help the Project progress-on schedule and within <br /> budget. The City will be asked to review, comment and approve design concepts, <br /> drawings, and documents at 30%, 60%, and 90%/final design within reasonable <br /> time frames as agreed to by the Parties. In no event shall these time frames be less <br /> than fourteen calendar days or more than twenty-one calendar days, unless <br /> otherwise agreed upon. <br /> The facility design will address ongoing maintenance and operations requirements <br /> of the transit operators. The City will be asked to confirm, in writing, their <br /> commitment and approval of a 30%design concept, Project elements, and site <br /> plan in order to verify that the Project may advance to the next design and <br /> engineering stages. To help ensure that the Project schedule is maintained and <br /> budget resources are carefully managed,the Project will not progress into the <br /> more specific engineering stages until this confirmation is secured at the 30% <br /> design stage. If one of the Parties to the Agreement expands the scope of the <br /> Project to the sole benefit of the Party sponsoring the expanded scope after 30% <br /> written confirmations, said Party will be responsible for the incremental cost of re- <br /> design and construction of the expanded scope element. <br /> 5. ENVIRONMENTAL REVIEW AND DESIGN: ROLES AND <br /> RESPONSIBILITIES <br /> 5.1 Sound Transit <br /> Sound Transit shall conduct all tasks necessary to successfully complete the <br /> Project's environmental review process under the State Environmental Protection <br /> Act (hereinafter referred to as "SEPA")and under the National Environmental <br /> Protection Act (hereinafter referred to as "NEPA") as required by the Federal <br /> Transit Administration (hereinafter referred to as the"FTA"). Such tasks include, <br /> but are not limited to, the following: <br /> • Preliminary planning, study, and design work required to conduct <br /> environmental reviews; <br /> • Preparation of all draft and final technical memoranda,reports and other <br /> written documents; <br /> • Conducting any necessary public hearings,meetings or requests for <br /> comments; and <br /> 5 <br />
