ATTACHMENT 1 <br /> constitutes a menace" in its present condition and use. According to the act, <br /> among other negative consequences, blighted areas constitute a "serious and <br /> growing menace", and an "economic and social liability." To address these problems <br /> the act provides a process for municipalities to improve these areas using such <br /> things as "acquisition, clearance, and disposition" of property "subject to use <br /> restrictions". <br /> To implement the law, a municipality, by resolution or ordinance, declares an <br /> area to be blighted and finds that a rehabilitation or redevelopment is necessary <br /> to remedy that blight. The act provides several options for implementation, <br /> including having the City directly undertake the renewal, establish an entity to <br /> carry out the renewal or appoint an agency such as a housing authority to <br /> perform the work. The City of Everett has adopted resolutions identifying the <br /> Everett Asarco site as a blighted area (Resolution No. 5503 attached as Exhibit A <br /> of this Plan). The City of Everett has authorized EHA to serve as a community <br /> renewal agency, to prepare a community renewal plan, and, upon adoption of <br /> the plan, to exercise all of the powers of a community renewal agency under the <br /> Community Renewal Law (Resolution No. 5504 attached as Exhibit B of this <br /> Plan). <br /> The act requires adoption by the City of a "Community Renewal Plan" that <br /> addresses specific requirements and outlines how the redevelopment will be <br /> generally undertaken. <br /> This Plan provides the framework for guiding how the redevelopment and <br /> rehabilitation of the Redevelopment Area is to be undertaken. The Plan <br /> identifies steps for the financing, acquisition and construction of improvements <br /> will occur. The Plan also includes a review framework and use restrictions that <br /> will be combined with the zoning designation and City development standards <br /> to process specific redevelopment project proposals. <br /> EHA has prepared this Plan in accordance with the provisions and requirements <br /> of the Community Renewal Law, RCW 35.81 (see Section 4 below). <br /> The City previously evaluated appropriate land uses and restrictions at the plan <br /> level in conjunction with cleanup options for the Redevelopment Area in the <br /> 1999 Final Cleanup Action Plan/Final Environmental Impact Statement for the <br /> Upland Area of the Everett Smelter Site (FCAP/FEIS) and in the 2003 <br /> Amendment/Addendum to the FCAP/FEIS.
