Failure to comply with any of the <br /> terms and conditions of this Agreement may lead to suspension or termination of <br /> HOME funding to the Agency. <br /> A. Designation. <br /> Contingent upon release of funds from the United States Department of Housing and <br /> Urban Development (hereinafter "HUD"), the Agency expressly agrees to undertake <br /> HOME eligible projects and programs, HOME 2003 #2 (hereinafter known as "HOME <br /> activities") more fully described in Attachment"A," Description of Activities, which is <br /> incorporated herein by reference. <br /> The undertaking of the HOME activities shall be in full accord with the HOME <br /> Investment Partnerships Act of 1990, as now or hereinafter amended (hereinafter"the <br /> Act"), and the rules and regulations promulgated thereunder. The Agency agrees to <br /> comply fully with all applicable Federal, State, and local laws, ordinances, and <br /> regulations in activities funded in whole or in part with funds provided through this <br /> Agreement and in carrying out the HOME activities in accordance with Attachment "A" <br /> or with any other terms of this Agreement. <br /> B. Financial Award. <br /> The Agency is hereby allotted through a financial award the amount of $ 486,862.00 <br /> (Four Hundred Eighty Six Thousand Eight Hundred Sixty Two Dollars) for the full <br /> undertaking and performance of the HOME activities. The award may be amended <br /> from time to time in any of the manners described elsewhere in this Agreement, so long <br /> as the same remains consistent with the object of Attachment "A", as now or hereafter <br /> amended. The sum of said award, or any amendments thereto, may only be expended <br /> in accordance with the budget in Attachment "B" hereto, which is incorporated herein by <br /> reference, as now or hereafter amended. <br /> C. Notice to Proceed. <br /> The County shall furnish the Agency with written Notice to Proceed upon release of <br /> funds from HUD related to the HOME activities pursuant to 24 CFR Part 58. No work <br /> on the HOME activities shall occur without written approval from the County. <br /> D. Term. <br /> This contract will be in effect from the date of execution by all parties and shall continue <br /> in effect until July 31, 2008. The Agency's obligation to the County under this <br /> Agreement shall not end until all closeout requirements are completed. Activities during <br /> the closeout period include, but are not limited to, making final payments, disposing of <br /> program assets, entry of all HOME activities Completion Reports into the Integrated <br /> Disbursement and Information System, reconciliation of all program balances, final <br /> reporting of utilization of program funds, and resolution of all disputes regarding <br /> program administration or rehabilitation work. <br /> II. PROGRAM REQUIREMENTS <br /> A. Uniform Administrative Requirements. <br /> The HOME activities shall be conducted and administered in compliance with the <br /> requirements of OMB Circular No. A-87 and the following requirements of 24 CFR part <br /> 85: ss 85.6, 85.12, 85.20, 85.22, 85.26, 85.32-85.34, 85.36, 85.44, 85.51, and 85.52. <br /> 2 � S 43 <br />
