7 • <br /> B. Other Program Requirements <br /> 1. Nondiscrimination And Equal Opportunity <br /> The Federal requirements set forth in 24 CFR 5.105(a), Nondiscrimination and <br /> equal opportunity, are applicable to participants in the HOME program. <br /> 2. Minority Outreach <br /> As a requirement of Federal funding, the Agency shall take affirmative action to <br /> encourage the use of minorities' and women's business enterprises (hereinafter <br /> "WMBE") in connection with HOME funded activities. In order to meet this goal, <br /> the Agency, for all its HOME activities funded wholly or in part with HOME funds, <br /> shall demonstrate a good faith effort to attain 7.7% WMBE participation as <br /> required by HUD for HOME activities. The Agency will submit an annual report to <br /> Snohomish County of all HOME contracts over $1,000. <br /> 3. The Federal regulations located in 24 CFR, Part 5, subpart A <br /> cover the following regulations that the Agency must comply with: <br /> Debarred, suspended and ineligible contractors; Drug free <br /> workplace; Disclosure requirements. <br /> 4. Affirmative Marketing. <br /> The Agency must submit an Affirmative Marketing plan for all HOME assisted <br /> projects and programs. This plan must be reviewed and approved by the County <br /> Office of Housing and Community Development. <br /> 5. Environmental Review <br /> a. NEPA <br /> The County retains environmental review responsibility for purposes <br /> of fulfilling requirements of the National Environmental Policy Act, <br /> under which the County may require the Agency to furnish data, <br /> information, and assistance for the County's review and assessment <br /> in determining whether the County must prepare an Environmental <br /> Impact Statement. <br /> b. SEPA <br /> The Agency retains responsibility for fulfilling the requirements of the <br /> State Environmental Policy Act and regulations and ordinances <br /> adopted thereunder. <br /> c. Compliance as a Pre-Condition <br /> Performance by the Agency under this Agreement shall include <br /> satisfaction of all applicable requirements of the National and State <br /> Environmental Policy Acts. <br /> C. Displacement, Relocation, and Acquisition <br /> 1. Acquisition <br /> Any acquisition of real property for any activity assisted by this Agreement <br /> which occurs to support the HOME activity, shall comply with the policies and <br /> 44 3 <br />
