Mr. Giffen <br />felt it was. <br />Councilman Diamond questioned enforcement of the zoning and .�hy the <br />property o�.v�ur was given a business license. Attomey Mike WP�o!::::.sk;�.�.�ed <br />that busmess licenses are a reguiatory matter for the collecdon of B&O tax and <br />oOther ordinances enforcc the zoning code. <br />Councilmembers eacpressed concem about a domino effect with other propertics <br />in that area with relation to the zoning change. They asked if the property <br />owner had considered purchasing property almady zoned for a small business. <br />Mr. Giffen answered that the applicant's representadve could address that <br />question. <br />Reid Shxkey, 2924 Colby Avenue, representadng Mrs. Harrington, the <br />property owner, recapped history aftcr the notice of violation had been issued. <br />He told councilmembers to answer the question, "Regazdless of any violation <br />dces this rezone make sense?" Her business is an intenor fumishings business <br />and this house is very compatable for the business. Mrs. Hazrington was not <br />aware of the wning problem. As far az the comp plan, many are based on <br />present use. <br />The map was reviewed again to further look at C-1 zoning across the strect and <br />the Eusy intersecdon W see if other properties should be included in this <br />amendment. Mr. Giffen explained that a SEPA review needed to be done and <br />it would need to be remanded back to the Planning Commission. He also stated <br />that The Comprehensive Plan is in the process of being updated. <br />Councilman Moser spoke in opposition to this amendment. <br />33 <br />
