Demolidon/Removal of Ezisting Buildinps. The applicant shail not <br />demolish or remove the ezisting buildings without first obtain►ng a permit from <br />the Public Works Department. <br />9. Completion of Improvements Required Herein. The site improvemenu <br />required by this Resolution shall be completed within the time periods specified <br />below. If the existing structure is to be used for commercial purposes, <br />subsection a. shall apply. If the ezisGng structure is enlazgell to exceed a total <br />of 2,000 square feet gross floor area, subsection b. shall apply. If a new <br />commercial swcture is built on the property, subsection b. shall apply. <br />a. Use of Ezisting Structure for Commercial Purposes. If the existing <br />structure on the premises is to be used for commercial purposes, the off- <br />street pazldng, street improvements, landscaping and all improvements <br />required by th�s Resolution and other City regulat�ons shall be completed <br />within one year of the date of approval of the Resolu6on of Intent to <br />Rezone by the Ciry Council. Upon compledon of all improvemenu <br />required by this Resolution, a rezone ordmance consistent with this <br />Resoludon shall be presented to the Ciry Council for their consideration <br />and approval. If the requirements spec�fied herein are not completed <br />within one year of the date of the adoption of this Resoludon by the Ciry <br />Co�mcil, this Resolution shall become void and all entitlemenu to the <br />uses permitted herein shall be forfeited, and any use inconsistent with the <br />R-1 zomng of the property shall be deemed a violation of ihe zoning <br />code and be subject W the violation, enforcement and penalty provisions <br />thereof. <br />b. Construction of a New Commercial Swcturo. In accordance With <br />City regulations, the applicant may remove the existing structure from <br />the proper,ry. for the purpose of construc6ng a new buildmg w be used <br />consistent with the terms of this Resoludon. If the ezisdng structure is <br />removed from the premises and a new structure is built for commercial <br />purposes, all improvements required by this Resolution and other City <br />regulat�ons shall be compieted w�thin one year of the date of issuance of <br />building permiu. Upon completion of the pazking lot and landscaping <br />improvements in accordance with the terms specified herein, a rezone <br />ordinance consistent with this Resolution shall be presented to the City <br />Council for their considention and approval. If all required perr.�its are <br />not obtained and the construction of a new building is not commenced <br />within two years of the date of adopdon of this Resolu6on by the City <br />Council, this Resoludon shall becom� void and all entidemenu to the <br />uses permitted herein shall be forfeited, and any use inconsistent with the <br />R-1 zomng of the property shall be deemed a violation of the zoning <br />39 <br />
