. � ; {� <br /> Jurisdiction: The Nearing Examiner of the Cfty of Everett has jurisdictional <br /> authority to hold a hearing and to issue the ►Bcommendetion. That authority is <br /> set forth in EMC 2.23.120. Based on the above findings, the Hearing Examiner <br /> enters the following conclusions: <br /> CONCLUSIONS <br /> 1. The Applicant requested approval of a Performance Agreement Rezone <br /> of a 6,000 square foot lot at 1825 Broadway Avenue, Everett, <br /> Washington. The specific request is for a rezone from the existing R-2, <br /> Single-Family Medium Density zoning designation to a B-2, Community <br /> Business designation. As part of the rezone, the Applicant sought a <br /> modification of the B-2, Community Business parking standarcls for a <br /> 10% reduction in the required parking. The resulting parking would have <br /> 46 parking spaces instead of the required 51 parking spaces per the B-2 <br /> standards. (finding 1) <br /> 2. The subject property is a Site Specific Rezone in that it applies only to <br /> one site within the City of Everett. (finding 2) <br /> 3. Being a Site Specific Rezone, the proposal includes a Performance <br /> Agreement Rezone in which a request has been made for a change in <br /> zoning classification subject to restrictions and conditions as imposed <br /> therein. (finding 1) <br /> 4. In order for a Site Specific Rezone to be approved, criteria as set forth in <br /> EMC 19.41.160 must be satisfied. With conditions as stated herein, <br /> those criteria are satisfied. (finding 5) <br /> 5. The proposed rezone is consistent with the Everett Comprehensive Plan. <br /> It also complies with the conditions as established by the City of Everett <br /> in the 1990 Comprehensive Plan Amendment and Intent to Rezone the <br /> properties west of McDougal Avenue between 18"' and 19�' Streets. <br /> (frndings 6 & 7) It allows for the commercial development of the subject <br /> property in a manner that wiil not be detrimental to other residential uses <br /> in the area. (findings 7, 8 & 10) <br /> 6. The proposed rezone has a substantial relation to the public health, <br /> safety and welfare. It is in the best long-term interest of the Everett <br /> community. The long-term interest includes a clear identification of the <br /> commercial use of the subject property while restricting and limiiing <br /> impacts to the residential adjoining properties.
