On June 28, 1988, the City of Everett City Council voted to reverse the Hearing Examiner's conclusion N6, reverse the Hearing Examiner's decision and direct approval of SPU /2-88 subject to the conditions recommended by the Planning Uepartment. �,�NDZNG3 1. A public hearinq was ::ald before the Ci.ty's Hearing Examiner on March 3, 1988 on the request by Everqreen Funeral Home for a Special Pr.operty Use Permit for consttuction of a crematorium. On March 21, 1988, the Hearing Examiner issued a decisian to deny the request for a Special Property Use Permit. The Hearing Examiner found that the T,pplicant could meet the crlteria of compatibility and environmental impact but did not show that the use would meet the �ublic need criteria. The Examiner stated, Although the use may serve a private convenience in that it provides an additionnl crematori.um it has not been shown that the proposed use will in fact serve the public convenfence or necessity. There are three • cremntoriums within the City of Everett and one of them provides cremation services to the l�pplicant. It appears that the crematorium requested by the Applicant is for financial reesons and convenienca rather than for public convenience and necessity. 2. On March 31, 1988, the Applicant requested that the Hearing Examiner reconsider his decision. 3. On ,�pril 15, 1988, the Hear�nq Examiner issued a decision to deny reconsideration. 4. On 1►pril 27, 1988 the Applicant submitted an appeal of the Heerin3 Exeminer':i decisi.on. In his appeal, the Applicant alleqed both an error in fact and an error in law and requested that tha City Cou�icil reverse the decisian of the Hearing Examiner and direct approval of Special Property Use Permit N2-88 subject to the conditions recommended by the Planninq Depar.tment of the City of Everett. The Applicant stated, The record does contain substantial evidence of a public need for full service funeral homes to alleviate problems of land use planninq associated with the dedication of larqe tracts of land for the burial of dead l�odies. Denial of the Appellants Special Property Use Permit request is discriminatory aqainst the Applicant. . . . There is no leqitimate basis for discriminntittq between the fun�ral homes already operating crematories and the special �se request of FXft�BrT 7: F�! Z
