On June 28, 1988, the City of Everett City Council voted to <br /> reverse the Hearing Examiner's conclusion N6, reverse the Hearing <br /> Examiner's decision and direct approval of SPU /2-88 subject to <br /> the conditions recommended by the Planning Uepartment. <br /> �,�NDZNG3 <br /> 1. A public hearinq was ::ald before the Ci.ty's Hearing Examiner on <br /> March 3, 1988 on the request by Everqreen Funeral Home for a <br /> Special Pr.operty Use Permit for consttuction of a crematorium. <br /> On March 21, 1988, the Hearing Examiner issued a decisian to deny <br /> the request for a Special Property Use Permit. The Hearing <br /> Examiner found that the T,pplicant could meet the crlteria of <br /> compatibility and environmental impact but did not show that the <br /> use would meet the �ublic need criteria. The Examiner stated, <br /> Although the use may serve a private convenience in <br /> that it provides an additionnl crematori.um it has not <br /> been shown that the proposed use will in fact serve the <br /> public convenfence or necessity. There are three <br /> • cremntoriums within the City of Everett and one of them <br /> provides cremation services to the l�pplicant. It <br /> appears that the crematorium requested by the Applicant <br /> is for financial reesons and convenienca rather than <br /> for public convenience and necessity. <br /> 2. On March 31, 1988, the Applicant requested that the Hearing <br /> Examiner reconsider his decision. <br /> 3. On ,�pril 15, 1988, the Hear�nq Examiner issued a decision to deny <br /> reconsideration. <br /> 4. On 1►pril 27, 1988 the Applicant submitted an appeal of the <br /> Heerin3 Exeminer':i decisi.on. In his appeal, the Applicant <br /> alleqed both an error in fact and an error in law and requested <br /> that tha City Cou�icil reverse the decisian of the Hearing <br /> Examiner and direct approval of Special Property Use Permit N2-88 <br /> subject to the conditions recommended by the Planninq Depar.tment <br /> of the City of Everett. The Applicant stated, <br /> The record does contain substantial evidence of a <br /> public need for full service funeral homes to alleviate <br /> problems of land use planninq associated with the <br /> dedication of larqe tracts of land for the burial of <br /> dead l�odies. Denial of the Appellants Special Property <br /> Use Permit request is discriminatory aqainst the <br /> Applicant. . . .
