A^ <br />0& <br />FACTS AND CONDITIONS IN THE SUPPORT OF <br />THE APPROVAL OF A SIGN VARIANCE <br />FOR THE <br />ARCO AM/PP1 MINI -MARKET <br />TO BE LOCATED AT <br />901 WEST CASINO ROAD, EVERETT, WASHINGTON <br />JOB NO. 2552 <br />The City of Everett Zoning Code Section 19.70.060 Jurisdiction -Variances -Conditions <br />authurizes the City to grant variances "in specific cases from the provisions and <br />requirements of this title (Title 19, City of Everett Zoning Code) not otherwise restricted <br />in this Section, as will not be contrary to the public interest; but only where owing to <br />special circumstances pertaining to a specific piece of property, the literal enforcement <br />of we previsin-.s or requirements of this title would cause undue or unnecessary <br />hardship. I his section of the City of Everett Zoning Code specifies specific findings of <br />facts and conditions which authorize the approval of a variance request. The following <br />are the applicant's responses to the four specific criteria set forth in this Section of the <br />City of Everett Zoning Code for the approval of a variance request. <br />A. "That there are exceptional or extraordinary circumstances or conditions <br />applying to the subject property or as to the intended use thereof, that <br />do not apply generally to other properties in the same vicinity or zone." <br />Annllcant's Resnonse: The stated purpose of the 13-1 (Neighborhood <br />Shopping Zone) "is to provide for and protect certain areas of the city <br />for retail businesses and services serving primarily the residents of the <br />surrounding neighborhood." The 13-1 zone permits not only retail <br />commercial uses, but also high -density single-family residents and low - <br />density multi -family residential dwellings. Automobile service stations, <br />such as the proposed ARCO AM/PM Mini -Market, are a permitted use in <br />the B-I Zone, Neighborhood Shopping Zone. The specific site of the <br />proposed ARCO AM/PM Mini -Market poses both exceptional and extraor- <br />dinary circumstances and conditions as to the intended use of the <br />property as a mini -market and retail gasoline sales outlet. This site is <br />unique as an automobile service station location, as it is an interior lot. <br />This is extraordinary, as generally automobile service stations are Incated <br />on corner parcels which are bounded by high -volume traffic streets on at <br />least two abutting sides. The unique character, location, and use of this <br />property do not generally apply to other automobile service uses in the <br />vicinity. These conditions and the fact that an automobile service station <br />is a permitted use in the zone, establish both an exceptional and an <br />extraordinary circumstance for this use. This fact, therefore, requires <br />the applicant to project a knowledge of this operation to the general <br />public by the use of a sign which does not meet the specific locational <br />criteria as specified in the Everett Zoning Code. The sign and number of <br />signs proposed for this development as well as the future adiacent <br />commercial development permitted by the 13-1 contract rezone of the <br />property will conform to the standard zoning code requirements. <br />2552.29 <br />
