as <br />go <br />Although the proposed ARCO AM/PM Mini -Market facility is not <br />permitted a free-standing or pole sign, the proposed future multi - <br />candidate commercial building to be located immediately west of the <br />ARCO site would be permitted the placement of such a sign under the <br />provision of Everett Zoning Code Section 19.24.020 Paragraph "IF." <br />The applicant simply requests the transfer of a property right, in this <br />case, the ability to place a free-standing or pole sign of 30-square feet <br />in area, from one property ownership to another adjacent ownership. The <br />transfer of this property right in no wav will affect either the number, <br />height, or size of the signs ultimately proposed or permitted within this <br />13-1 zoned area. <br />B. "Thrt such variance is necessary for the preservation and enjoyment of <br />such a substantial property right of the appellate possessed by the <br />owners of other properties in the same vicinity." <br />Applicant's response: The ARCO AM/PM Mini -Market with retail gasoline <br />sales proposed for this location is a permitted use in the B-I, Neighbor- <br />hood Shopping Zone. This use is also permitted in other zoning districts <br />which are in the vicinity of this site. The mid -block location of this site <br />necessitates the request for a variance to allow the proposed development <br />the opportunity to successfully operate a permitted commercial use on the <br />site. Visibility and general knowledge of the commercial activity on this <br />site will be limited due to the fact that this commercial node is <br />extremely small compared to other commercial areas generally found <br />within the city, and the mid -block location of this site will provide the <br />facility with visibility from West Casino Road only. The intended use of <br />this property, an ARCO A1,1/PM Mini -Market with retail gasoline sales <br />presents signage needs which are unique to the automobile service station <br />industry. Unlike other commercial uses, the automobile service station <br />requires not only n need to identify the facility, in this case the ARCO <br />AM/PM Mini -Market, but also requires the need to advertise the price or <br />prices of its primary products, in this case, the various grades of <br />petroleum products sold. This extraordinary circumstance, which is <br />unique to the automobile service station industry, requires that the <br />applicant request the Board of Adjustment to approve the transfer of a <br />property right to permit the placement of a free-standing or pole sign <br />which will not exceed the zone IimitatlonS for height or size from the <br />adjacent commercial development to the ARCO property. The transfer of <br />this properly right to the placement of n free-standing or pole sign will <br />provide the applicant with the necessary size and height to both identify <br />the business and advertise prices of the products. <br />2552.29 <br />
