"That the authorization of such a variance will not be materially <br />detrimental to the public welfare or injurious to property in the vicinity <br />or zone in which the property is located." <br />Applicant's Response: The approval of the Board of Adjustment to permit <br />the transfer of the property right to the placement of a free-standing or <br />pole sign from one property owner to an adjacent property owner within <br />the same zone and, more specifically, within a contract zone district, <br />cannot be considered to be materially detrimental to the public welfare or <br />injurious to properties in the vicinity or zone. There is B4 intent within <br />this request to exceed the sign height, sign number, or sign size, as <br />stated within the basic sign parameters as delineated within the Everett <br />Zoning Code Section 19.24.020 Paragraph "F." <br />D. "That the granting of such variance will not adversely affect the <br />COMPREHENSIVE GENERAL PLAN." <br />Apnlicant's Response: The subject site of this ARCO AM/PM Mini - <br />Market facility is located on the north side of West Casino Road between <br />Eight Avenue West and 10th Avenue West. The Southwest Everett <br />Comprehensive Plan denotes the recommended land use for this area to be <br />neighborhood business (NB). The transportation map also included in this <br />plan shows West Casino Road designated as a major arterial. Both the <br />land use designation and the roadway designation would indicated that the <br />development of an ARCO AM/PM Mini -Market at this site would not <br />adversely affect the Comprehensive General Plan. A specific review of <br />the Southwest Everett Comprehensive Plan did not fine' particular <br />reference to the applicability or criteria for signage in neighborhood <br />business areas. The plan does, however, reference, in the section <br />entitled, "Neighborhood Convenience Commercial Areas," the need for <br />placement of small commercial centers offering basic neighborhood <br />services in the Nest Casino area. Specifically, the plan lists these uses <br />as convenience stores, laundry mats, day care centers, branch banks, and <br />post offices, etc. The plan further recognizes the mix of commercial and <br />residential uses in this area. <br />The site of the proposed ARCO AM/PM Mini -Market facility is a portion <br />of a contract rezone area, which is a recommended element of the <br />comprehensive plan. Of particular note is the recognition within the <br />Southwest Everett Comprehensive flan, that the plan recognizes that <br />certain elements of the Zoning Code or other regulations may require <br />modification to implement the direction and policy of the plan, "changes <br />in the detail of Zoning Code elements or other regulations may be <br />necessary as a result of adoption of the Southwest Everett Plan." It <br />might be assumed that the changes about which the Southwest Everett <br />Comprehensive Plan speaks may be to the sign code regulations, which <br />are applicable to the B-1 Zoning District. If, in fact, the sign require- <br />ments are an element of the Zoning Code about which the comprehensive <br />plan recognizes the necessity of change, the granting of the requested <br />rezone will only MI adversely affect the comprehensive plan, but may, in <br />fact, initiate the implementation of that document. <br />-3- <br />
