He seeks a <br /> varianee to allaa a single lot at the crocner of 15th and Colby Avenue <br /> to be subdivided into a two-Iot short subdivision. Nrrently on the <br /> property is a single lot with two residences. It is the intent of the <br /> Applicant to short subdivide the one lot into two lots. 'It�e Applicant <br /> also requested a reduction of the side yard setback for one of the <br /> proposed lots. Znstead of the requiced five foot side yard setback, <br /> the lot at 1431 Colby will have .46 side yard setback. (Wood testimony) <br /> 2. 7fie Applicant resides at 1431 Colby, w�hich is one of the lots. It is <br /> the irtent of the Ap�rlicant to have this lot be divided into a 4,350 <br /> squace foot lot. Zhe other lot, which fronts on 1609 lfith StLeet, is <br /> located in tlie far northeast corner of the existing lot. (exhibit 2) <br /> 3. 'fiere is a garage on the Applicant's property on 1431 Colby Avenue. <br /> Upai subdivision, it will remain with this lot. (McKee testimony) <br /> 4. �he subject property is a 50 x ll8 foot parcel of land which has two <br /> structures located on it. It is the intent of the Applicant to divide <br /> the lot into two lots, with lot �1 consisting of 4,350 square feet <br /> (1431 Colby) and lot A2 consisting of 1,550 square feet (1609 - 16th <br /> Street) . (staff report) <br /> 5. Tfie propecty is zoned R-2. 'Itie minimian lot requirement for R-2 zoned <br /> property is 5,000 square feet. Both lots of the subdivision will be <br /> less than 5,000 square feet. 'Ifius, the Applicar�t needs a variance for <br /> the short plat in order to create two lots that have existing <br /> structures. (staff report) <br /> 6. Ordinance 1119-85, as amended by Ocdinance 1327-87, sets forth the <br /> authority foc variances for division of land with existing structuces. <br /> Section 6.A.1 and Section S.C.2 specifically state that new divisions <br /> of land, or the crzation of new lots with existing structuces, can be <br /> done through the use of variances. (EVerett Municipal Code) <br /> 7. Section 6.A.5 of the Subdivision Ordinanoe sets farth the criteria for <br /> review of variances. Zhese include: <br /> A. There are exceptional circumstances or conditions such as: <br /> 1. location of existing structuces, lot configuration. <br /> topographical or unique physical featuces that apply to the <br /> subject property which prohibit the Applicant from meeting <br /> the standards of this ordinance; <br /> B. 7tie authorization of a variation will not be detrimental to the <br /> public welfare or injurious to the propecty in the vicinity or <br /> zone in which the property is located; and, <br />
