Paul McKee
Va:ianae 1-89
Page -3-
C. A hardship .ould be incurred by the Applicant if cequired to
:omply with the strict application of the section or sectior.s
identified in Section 6.A.1 herein. (administcative finding)
8. Dcceptional circumstances exist for the granting of a vaciance.
Hecause the single lot has two structures on it, the Applicant's
application for a variance is warranted. (Wood testimony, staff report)
9. 'Ihe granting of a variance will not be detrimental to the public
aelfare or injucious to the property in the vicinity in which it is
located. Beaause thece are two single family dwellings on one lot, the
division of the lot will prwide a systematic division of the proEerty
in order to create two separate lots in the acea. (Wood testimony)
10. Without the variance, a hardship woulA c incurced by the Applicant.
Because of the limitation of one residence per lot, the lpplicant could
be restricted in the sale and finance of the two houses. (staff
report)
ll. A letter of protest was received in opposition to the variance fran
Williavn E. Hmvnel. He requested that the property not ne short platted
and that the current zoning is appropriate for the propecty. (exhibit
4)
12. 1te setback varfance is sought for the lot at 1931 Colby Avenue. Zhe
setback is sought in ocder that the garage on site can remain even
though it does not satisfy the setback standards for this particular
zone. (Wood testimony)
13. 'Itie erett Planning Department recoimiended approval of the variance.
(staff report)
14. A Witness (Oursler) submitted no opposition to the request of the
Applicant but was concerned about any change in the use of properties
in the area. She su6mitted that effort should be made to protect the
single family nature of the neighborhood.
CONCfAS IONS
1. Zhe application is for the approval. cf variances to allow two
substandard lots to be created by a short subdivision and for a
reduction of the five foot setback to a .46 setback for an existing
garage on one of the lots, the lot at 1931 Colby Avenue.
2. Section 6.A of Ordinance 1119-85, as amended by Ordinance 1327-87,
allows for variances for division of land with existing structures on
it. ifie Applicant's request comes under this jucisdictional
authority.
