measures must be reviewed and approved by the Public Works <br />Department. <br />2. Intersection Improvements <br />Mitigation for intersection improvements must be provided per <br />either item a. or b. below: <br />a. The Applicant must pay the Proposed Action's pro rata share <br />contribution to the intersection improvements shown in the <br />attached Table 9 per the Interim Traffic Mitigation Ordinance. <br />The Applicant must pay $154,308 to the City prior to issuance <br />of the first building permit for the proposal. <br />If the project is phased and the theater proceeds first, the <br />Applicant must pay a proportion of $154,308 based upon the <br />percentage of the peak hour vehicle trips generated by the <br />theater. The remaining amount must then be paid prior to <br />issuance of any Building Permits for the office/retail <br />building. <br />No <br />b. At the time of issuance of any specific Building Permit, the <br />Applicant shall pay its pro-rata share contribution to the <br />intersection improvements shown in the attached Table 9, in <br />proportion to the proposed phase of development. Approved <br />updated traffic studies will be used to determine the pro-rata <br />share for each subsequent phase. The cumulative payment from <br />the Applicant for Phases described in Section II above shall <br />not exceed $154,308: provided, however for all applications for <br />Building Permits (not including tenant improvements) applied <br />for after January 29, 1994, traffic fees shall be based on an <br />approved traffic study performed in accordance with the <br />Policies and ordinances in effect at the time of Building <br />Permit application. <br />K. TRANSPORTATION: ON -SITE CIRCULATION AND ACCESS (SEPA Land and <br />Shoreline Use, Transportation, and Energy and Natural Resources <br />Policies, Interim Traffic Mitigation Ordinance No. 1670-89, as <br />amended) <br />1. Prior to issuance of any permits for structures that extend into <br />the alley, a right-of-way lease or vacation must be obtained. <br />2. Prior to issuance of the first building permit for the <br />Office/retail building, a public alley must be established between <br />Wetmore and the existing alley. The alley must be 35 feet wide <br />and improved to Public Works requirements, including curb and <br />gutter. Landscaping is required as shown on the approved site <br />plan.
