RECEIVED <br /> op <br /> E C 2 3 2003 <br /> INTERLOCAL AGREEMENT 6P E R AT I O N S & <br /> BETWEEN MAINTENANCE <br /> EDMONDS SCHOOL DISTRICT AND THE CITY OF EVERETT <br /> FOR WATER CONSERVATION AUDITS <br /> This Agreement is by and between the City of Everett, a first class city in the State of <br /> Washington, and Edmonds School District, of Lynnwood, Washington and is effective as <br /> of December 12,2003. <br /> 1. Parties <br /> The parties to this Agreement are the City of Everett, a Washington municipal <br /> corporation (hereafter"City") and Edmonds School District, a political subdivision of the <br /> State of Washington (hereafter"District"). The parties are located in and exist under the <br /> laws of the State of Washington. <br /> 2. PURPOSE AND RECITALS <br /> 2.1 Authority. This interlocal Agreement (hereafter "Agreement") is entered into <br /> pursuant to chapter 39.34 RCW (Interlocal Cooperation Act), chapter 36.75 RCW, and <br /> RCW 35.77.020 - .040. <br /> 2.2 Background. Under the regional water conservation program, the City and its <br /> wholesale water customers provide funding to school districts for irrigation system <br /> improvements. Such payments are authorized under RCW Chap. 35.92 and RCW Chap. <br /> 54.16. <br /> 2.3 Purpose. The purpose of this Agreement is to establish a mechanism for the <br /> District to request a water conservation audit, for the District to request reimbursement <br /> for water conservation measures identified by such audit, and for the City to reimburse <br /> the District. <br /> 3. DURATION <br /> This Agreement shall become effective upon execution by all parties and shall remain in <br /> effect for one year,unless extended by written amendment signed by both parties. <br /> 4. PROGRAM <br /> 4.1 To enroll in the program,the District requests in writing an irrigation system audit <br /> . from the City. The purpose of the audit will be to identify improvements and <br /> quantify the water savings from these improvements. <br /> 4.2 The City will usually take the request to a committee of representatives from the <br /> City and its wholesale water group ("EWUC Committee") for review. If the <br /> EWUC Committee approves, the City may hire a vendor to conduct the audit. By <br />
