r <br /> 1 2 6. Uses <br /> The Premises are to be used for general office purposes, in accordance with accepted community <br /> standards for general offices within downtown Everett("Permitted Uses") and for no other purpose <br /> without the prior written consent of City,which consent may be withheld if City in its sole <br /> discretion determines that any proposed use is either(i) inconsistent with the maintenance and <br /> operation of the Building as an office building, or(ii) inconsistent with the conditions, covenants, <br /> restrictions and Rules and Regulations applicable to the Building. No act shall be done in or about <br /> the Premises that is unlawful. Workforce shall not commit any act that will increase the then <br /> existing rate of insurance (primary or excess) on the Building without City's consent. Workforce <br /> shall promptly pay upon demand the amount of the increase in insurance caused by such act or acts <br /> done by Workforce. Workforce shall not commit or allow to be committed any waste upon the <br /> Premises, or any public or private nuisance or other act which disturbs the quiet enjoyment of any <br /> other tenant in the Building. Without the written consent of City, Workforce shall not use any <br /> apparatus, machinery or device in or about the Premises that will cause any substantial noise, <br /> vibration or fumes. If any of Workforce's office machines or equipment should disturb the quiet <br /> enjoyment of any other tenant in the Building, then Workforce shall provide adequate insulation, or <br /> take other action as may be necessary to eliminate the disturbance. Workforce shall comply with all <br /> laws relating to its use or occupancy of the Premises and shall observe such reasonable rules and <br /> regulations (not inconsistent with the terms of this Lease) as may be adopted and made available to <br /> Workforce by City from time to time for the safety, care and cleanliness of the Premises or the <br /> Building, and for the preservation of good order therein. Workforce shall not install laboratories, <br /> nor shall it conduct laboratory experiments or research in the sciences or engineering without the <br /> prior written consent of the City. Workforce shall not keep on or about the Premises for use, <br /> disposal,treatment, generation, storage, demonstration or sale any substances that are hazardous, <br /> toxic, harmful or dangerous, and/or which are subject to regulation as hazardous or toxic, <br /> dangerous, or as a pollutant by any federal, state, or local law, regulation statute, or ordinance <br /> (collectively referred to as "hazardous substances"). Workforce shall be fully liable to City and <br /> shall indemnify, defend and save harmless City and its officials and employees, with respect to any <br /> and all damages, costs, fees (including attorney's fees and costs), civil and criminal penalties, or <br /> clean-up costs assessed against or imposed as a result of Workforce's use, disposal, generation, <br /> storage, demonstration or sale of hazardous substances or that of Workforce's employees, agents or <br /> invitees. Breach of this provision shall entitle City to terminate this Lease. <br /> 7. Additional Rent <br /> In addition to and together with the Rent, Workforce shall pay Additional Rent for the actual, <br /> janitorial services provided in the useable space and for metered electricity. <br /> Page 6 of 21 <br />
