<br /> NONWAIVER OF COUNTY RIGHTS
<br /> The County's failure to insist upon the strict performance of any provision of this Agreement, to exercise
<br /> any right based upon a breach thereof, or the acceptance of any defective performance, shall not
<br /> constitute a waiver of any rights under this Agreement, unless stated to be such in writing signed by an
<br /> authorized representative of the County and attached to the original contract.
<br /> PERFORMANCE STANDARDS AND LICENSING
<br /> The Contractor shall comply with, all applicable local, state, and federal licensing and accrediting
<br /> requirements/standards and any other standards or criteria established by the County to assure quality of
<br /> services necessary for the performance of this Agreement.
<br /> SERVICES PROVIDED IN ACCORDANCE WITH LAW
<br /> The Contractor shall comply with all applicable Iaws, rules, ordinances, codes and regulations of local,
<br /> state, and federal governments, as now or hereafter enacted or amended.
<br /> NONDISCRIMINATION
<br /> During the performance of this Agreement, the Contractor and its subcontractor(s), if any, shall comply
<br /> with federal and state laws against discrimination including, where applicable, the state funding agency's
<br /> nondiscrimination plan. Nondiscrimination requirements include, but are not limited to:
<br /> Nondiscrimination in Employment:
<br /> A. The Contractor and it's subcontractor(s), if any, shall not discriminate against any employee or
<br /> applicant for employment on the basis of race, color, sex, sexual orientation, religion, national
<br /> origin, creed, marital status, age, Vietnam era or other veteran's status, or, mental or physical
<br /> handicap.
<br /> B. The Contractor and it's subcontractor(s), if any, shall take affirmative action to ensure that
<br /> employees are employed and treated during employment without discrimination on the basis of
<br /> race, color, religion, sex, sexual orientation, national origin, creed, marital status, age, Vietnam
<br /> era or other veteran's status, or mental or physical handicap. Such action shall include but not be
<br /> limited to the following: promotion, demotion, transfer, termination, recruitment, advertising,
<br /> training, apprenticeships and rates of pay or other forms of compensation and benefits.
<br /> C. The Contractor and it's subcontractor(s), if any, shall agree to post in a conspicuous place
<br /> available to employees and applicants for employment notices provided by the County setting
<br /> forth the provisions of this nondiscrimination clause.
<br /> D. All solicitations, advertisements, or announcements for employees, volunteers, board or advisory
<br /> committee members will include reference to the Contractor's policy of nondiscrimination and
<br /> affirmative action. Classified advertisements shall include the initials "EEOC/AA". All other
<br /> solicitations, advertisements or announcements shall include the following statement:
