8 <br /> 5. ENVIRONMENTAL REVIEW AND DESIGN: ROLES AND <br /> RESPONSIBILITIES <br /> 5.1 The City of Everett <br /> The City shall conduct all tasks necessary to successfully complete the Project's <br /> environmental review process under the State Environmental Protection Act <br /> (hereinafter referred to as"SEPA") and under the National Environmental <br /> Protection Act (hereinafter referred to as"NEPA") as required by the Federal <br /> Transit Administration(hereinafter referred to as the "FTA"). Such tasks include, <br /> but are not limited to,the following: <br /> • Preliminary planning, study, and design work required to conduct <br /> environmental reviews; <br /> • Preparation of all draft and final technical memoranda, reports and other <br /> written documents; <br /> • Conducting any necessary public hearings, meetings or requests for <br /> comments; and <br /> • Filing necessary documents with the City, State, and the Federal Transit <br /> Administration(FTA), and communicating with FTA through the point of <br /> final approval. <br /> Sound Transit will rely on the City's SEPA review to support its commitment of <br /> funds into the Project. Accordingly, the City will provide Sound Transit with an <br /> opportunity to review and comment on the SEPA documentation prior to issuance. <br /> In addition,the City will complete its SEPA review prior to Sound Transit <br /> reimbursing the City for any costs beyond environmental review and preliminary <br /> engineering under section 9 of this Agreement. <br /> 5.2 Sound Transit <br /> Sound Transit may participate in the Project at its discretion to ensure that its <br /> financial contribution to the Project is appropriately expended by the City. Such <br /> participation by Sound Transit may include, but is not limited to,the following <br /> Project processes and decisions: the development of design configurations, input <br /> into Project-level environmental review, public involvement, design, permitting, <br /> and pre-construction processes through the Project Management Team. <br /> 6. OWNERSHIP <br /> The Project shall be owned solely by the City. The City shall be solely <br /> responsible for the Project's operation and maintenance. <br /> 5 <br /> q <br />
