does not adversely affect the operation and performance of the facility. The Contractor shall <br /> provide construction management services as described in the Contract from the effective date of <br /> this Contract and through construction completion and close out of the project. These services <br /> include, but are not limited to, management of the public competitive bidding of subcontractor <br /> work by solicitation and award of subcontractor bid packages. The description of services in this <br /> Article 2 are in addition to,or examples of, general contracting and construction services <br /> required by the Contract, and do not limit Contractor's obligation to provide any and all general <br /> contracting and construction services required by the Contract or that are reasonably necessary to <br /> construct the Project. <br /> 2.2. Supplemental Contract Documents <br /> The Contractor acknowledges the Contract Documents may not be fully completed or developed <br /> at the time of the execution of this Agreement and has included amounts in the MACC <br /> Contingency in the event additional compensation is justified because of incomplete Contract <br /> Documents. The Contractor agrees to cooperate with the Owner and the Engineer in order to <br /> satisfy the Owner's requirements for the Project and to incorporate all the Work described under <br /> other Contract Documents hereafter completed or developed. The Contractor and the Owner <br /> recognize that construction may commence on the basis of incomplete Contract Documents; and <br /> in such event, additional Contract Documents will be prepared and issued, from time to time, for <br /> purposes of construction which will detail more completely all requirements of the Work. The <br /> Contractor and Owner have agreed to the Maximum Allowable Construction Cost (MACC) set <br /> forth above. The Contractor represents to the Owner that the Contract Documents are <br /> sufficiently complete to enable the Contractor to establish the Guaranteed Construction Cost <br /> (GCC) of the Work, and the issuance of subsequent Contract Documents will not affect the GCC <br /> of the Work,unless a change in the scope of the Work is required. A claim for change in the <br /> scope of the Work is not warranted if the portion of the Work was reasonably inferable from or <br /> contemplated by,or a prudent contractor should have realized such Work was necessary or <br /> appropriate under the Contract Documents in existence at the time the GCC for the Work was <br /> approved by the Owner. During performance of the Work,the Contractor agrees to use its best <br /> efforts, exercising its best and prudent judgment,to accomplish the Work in conformance with, <br /> and as required or described by, or referred to in, the Contract Documents then available and <br /> developed. <br /> 2.3. Construction Administration and Management. <br /> 2.3.1 Manage construction of the project. The Contractor will serve as general contractor <br /> and will carry out the construction of the Project through subcontracts. <br /> 2.3.2.Coordinate all on-site construction activities.
