� <br /> 10.2 Hazard�s_ S�ances. Tenant agrees to comply with al] annlicahle air <br /> and water pollution control and prevention laws, regulations and state and federal air pollution <br /> and water pollution control agencies' recommendations 1Dvi h all federa�and statle ]aws�and <br /> located on the leased Premises. Tenant agees to comply <br /> regulations regarding hazardous waste or substances. In the event of any discharge by Tenant or <br /> Tenant's agents of hazardo:�s or toxic substances on or to the Premises, after execution of the <br /> lease, Tenant shall immediately notify Landlord and all relevant govemmental agencies, and <br /> restore the Premises to its previous condition. After the terminition of this ]easc for any reason, <br /> Tenant shall remove ali hazardons and toxic materials and containers for those materials from the <br /> Premises. <br /> Tenant hereby indemnifies and holds harmless the Landlord, its successors and assigis, <br /> from any and all claims, damages, fines, judgnents, penalties, costs, liabilities or losses <br /> (including, without limitation any and all sums paid for settlement, claitns, attomeys' fees, <br /> consulting and expert fees) relating to or in connection with the presence or suspected presence <br /> of haz:u'dous or toxic substances or materials ("hazardous substances ) in or on the Premises or <br /> areas adjacent to the Premises, to the extent the hazardous substanccs are present as a result of <br /> the negligence, williul conduct or other ar,ts of Tenant, Tenant's agents, employees, contractors <br /> or invitees, or which are present because the hazazdous substances were physically placed upon <br /> the Premises during the term of the lease. VVithout ]imitation of the foregoing, this <br /> indemnification shall include any and all costs incurred due to any investigation of the site or any <br /> cleanup, removal or restoration mandated by any federal, state or local agency or political <br /> subdivision. This indemnification is intended to survive termination of this]ease. <br /> 10.3 Dis osal of Non-Hazardous Waste Materials. All non-hazazdous �vaste <br /> materials shall be disposed of by Tenant properly and in accordance wiih all applicable laws and <br /> regulations. <br /> 10.4 Comaliance With Law. Tenant shall not use die Premises or permi: <br /> anything to be doue in or about the Premises �vhich will in any way conflict with any 1aw, <br /> statute, zoning restriction, ordinance or governmental rule or regulation or requirements of duly <br /> constituted public authorities now in Force or which may hereafrer be enacted to promt:lgated. <br /> Tenant shall at its sole cost and expense promptly comply with all laws, statutes, ordinances and <br /> govemmental rules, regulations or requirements now in force or which may hereafter be in force <br /> and with the requirements of any board of fire undenvriters or other similar body now or <br /> hereafter constituted, or requirements of Landlord's casualty insurance provider, relating to or <br /> affecting the condition, use or occupancy of the Premises, or required improvements or <br /> alterations thereto. <br /> 10.5 Minimum Oaeratine Hours. The Premises shall be kept open for <br /> business by Tenant, with reasonable amounts of inventory and staffing, at ]east from 11:00 a.m. <br /> t]�rough ?:00 p.m., Monday through Saturday, at all times during the term of this Lease, except <br /> legal holidays.
