e. Prior to issuance of any permits, detailed landscaping plans showing the <br />size, type and location of plantings must be reviewed and approved by the <br />Planning Department per Section 35,100 of the Zoning Code. The <br />landscaping plan must also show location and dimensions of required <br />vegetated swales, wetponds, detention ponds, rockeries and retaining <br />walls, and grading at 2 foot intervals. Irrigation systems must be provided <br />in all landscaped areas per Section 35.130 of the Zoning Code. A 2 year <br />r-iaintenance assurance device must be provided for the landscaping per <br />Section 35.1308 of the Zoning Code. <br />41. Signage regulations for the shepping center are defined under section 36 of the <br />City's Zoning Cude. The applicant is proposing the construction of a new <br />"nostalgic" style McDonald's restaurant building that incorporates golden arches <br />into the roof structure of the new building. Roof signs are typically prohibited <br />under section 36.030 of the zoning code, however the applicant has made <br />application for a Comprehensive Sign Design Permit approval per section 36.210 <br />of the zoning code. Under this section of the code the Planning Director may <br />allow special deviations from the requirements and restrictions of the sign <br />regulations when an applicant is using a comprehensive design plan to integrate <br />signs into the framework of the building or buildings, landscaping and other design <br />features of the property, utilizing an overall design theme. <br />Based upon the exhibits submitted by the applicant, the Planning Director has <br />determined that an exceptional effort has been made toward creating harmony <br />between the signage and the proposed building and the Comprehensive Sign <br />Design Permit is hereby approved. The golden arches passing through the <br />buildings roof structure support the builuing's "nostalgic" look and architectural <br />style. However, the free-floating speedy sign does not add to the building <br />architecture and will not be permitted above the roofline. All other signage on the <br />site shall be in compliance with the City's sign code regulations. <br />42. A note must be placed on the Binding Site Plan stating: "The site shall be <br />developed per the approved site plan on file with the City of Everett Planning <br />and Community Development Department titled Site Development Plan <br />(Exhibit A, BSP #00-003) and with all conditions of the SEPA FMDNS #00- <br />022:' <br />43. Changes noted on the BSP and Site Development Plan mark-ups stamped <br />approved and dated 6/5/00 shall be incorporated on the final maps. <br />44. Compli-;nce with all conditions of the FMDNS SEPA#00-022 are required prior to <br />tinal approval. <br />
