All improvements shall be <br />completed, approved, and warranted before Occupancv permits are issued. <br />2. 30 feet of right-of-way is to be dedicated to the City for street purposes for 104th Street <br />S.W. per Ordinance 555-78 as amended. <br />3. Interim street improvements are required to 104th Street S.W. including, but not limited <br />to, curb, gutter, sidewalk, street widening, transitions and drainage control per City <br />standards per Ordinance 555-78 as amended. Any unused portions of the 104th Street <br />right-of-way may may be used as wetland buffer, as authorized by the Public Works <br />Department. <br />4. A one-year warranty is required on the public improvements for an amount not less than <br />10% of the cost of construction and shall run for one year from the date of issuance of <br />the first Occupancy Permit for the project. <br />5. On -site watermain will be staked within an easement to the City. The easement must <br />be submitted to the City prior to the issuance of permits. <br />6. As-builts of storm sewer, sanitary sewer, and water systems must be submitted per City <br />Design and Construction Standards and Specifications. <br />7. Parking must be per City Zoning Code and City Design and Construction Standards and <br />Specifications. For the 33,683 square feet of retail space and 6,800 square foot <br />restaurant, a minimum of 135 parking stalls is required (shopping center standard). <br />Parking for the storage building shall be per the Zoning Code. Handicap spaces must <br />be provided for each building. <br />8. A note must be placed on the Binding Site Plan stating: 'The site shall be developed <br />per the Site Plan on record with the City of Everett Planning and Community <br />Development Department (Exhibit A, BSP # 5-95), and with all conditions on the <br />SEPA MDNS 078-95-Second Revision." <br />9. The following note must be placed on the Binding Site Plan map: "Approval of the <br />Binding Site Plan is based upon a combination of retail, restaurant and storage <br />uses on the site. Any change of use or substantial changes in the site layout <br />must meet the development standards of the C-1 zone, and may require a Binding <br />Site Plan amendment." <br />F <br />10. The applicant must provide acceptable Declaration of Joint Easement, Covenants and <br />Restrictions for use and maintenance of common areas. The common area shall be all <br />areas not covered by buildings. A note must be placed on the Final Binding Site Plan <br />Map stating: "Common area agreements for use and maintenance of access, <br />circulation, parking, utilities, and landscaping is recorded under Auditor's File 400 <br />11. Based upon 75,000 square feet of Type V-N, sprinklered construction, tho flow <br />requirement is for the two retail structures is 3,750 GPM. Note: this represents an <br />increase over the original approval and relates to the size of the storage structure. <br />12. A fire hydrant is required within 200 driving feet, but not closer than 50 feet, of every <br />structure. Four (4) available hydrants are required. The location of the hydrants must <br />be approved by the Fire Marshal. <br />
