13. Implementation of the final approved wetland mitigation plan must occur prior to the <br />issuance of a certificate of occupancy for the first building. Implementation measures <br />shall include, but not be limited to: a pre -construction meeting between the applicant's <br />wetland biologist, contractor, and city planning staff; field marking of the mitigation area <br />with construction and sedimentation fencing; clearing and grading of the mitigation area; <br />installation of wetland soils from the wetland to be filled or alternative source and; <br />revegetation of the wetland and buffer areas with native plant species. <br />14. Prior to issuance of any permits, the Applicant must pay a mitigation fee of $68,526 <br />($22,754 for Office Max; $23,682 for retail/storage buildings; and $22,089 for the <br />restaurant) per the Interim Traffic Mitigation Ordinance No. 1670-89, as amended. <br />15. A maximum of two freestanding signs will be permitted on the site. Both signs shall be <br />oriented to Everett Mall Way, and shall not be oriented to 104th Street. The maximum <br />sign area for each business shall be 75 square feet. <br />16. Construction access will be limited to Everett Mall Way, except for construction of 104th. <br />17. The Applicant shall be responsible for Rite distance and/or channelization improvements <br />at 4th Avenue S.W./104th to address safety impacts of the additional traffic on 104th <br />resulting from this proposal. <br />SITE PLAN REQUIREMENTS FROM SEPA MDNS *78-95--Second Revision dated <br />November 18, 1996: <br />1. Any grading/fill on this site shall be done so as to not impact the surrounding properties. <br />(SEPA Earth, Land and Shoreline Use Policies.) <br />2. Special charges for connection to the sewer and water systems in accordance with <br />Ordinance 1998-94 and subsequent revisions are applicable. These charges are based <br />on projected water usage and can be substantial. The Applicant is encouraged to obtain <br />a copy of the ordinance and determine estimated charges prior to building permit <br />application. The actual charges shall be computed by the Public Works Department per <br />the ordinance in effect at the time of building permit issuance. <br />3. This project must comply with the current City of Everett Building Code and Sprinkler <br />Ordinance. <br />4. Stormwater detention/retention, quality protection, and treatment requirements for this <br />project shall be those requirements in effect at the time of application for Public Works <br />permits. Stormwater treatment is currently required when 10,000 square feet of <br />pavement is created by a project and three options for stormwater treatment are <br />presented in the current City standards. The least preferred option is allowed only if the <br />first two options are infeasible in the opinion of the Public Works Department. The <br />options for stormwater quality enhancement are, in order of preference: <br />1) An infiltration basin designed and constructed according to city standards. <br />2) A wetpond designed and constructed to city standards. <br />3) A baffle -type oil/water separator followed by a vegetated swale, both designed <br />and constructed according to city standards. <br />
