<br />SPECIAL TERMS AND CONDITIONS
<br />Article I — COMPENSATION SCHEDULE:
<br />1. PROJECT FUNDING
<br />The Department will administer the Mitigation Grant Program and will commit the required state match and
<br />pass through the federal match. The Applicant will commit the required local match.
<br />a. The total cost of the project for the purposes of this Grant Agreement is $25,000 dollars; PROVIDED
<br />that, if the total cost of the project when completed, or when this Grant Agreement is terminated, is
<br />actually less than above, the actual cost shall be substituted herein.
<br />b. The value of the contributions by the Applicant to the project shall be $3,125 dollars, or 12.5% percent,
<br />at minimum, of the total project cost.
<br />c. Subject to the terms of this Grant Agreement, the Department agrees to provide $3,125 dollars, or
<br />12.5% percent of the total project cost, whichever amount is less.
<br />d. When the Department enters into an agreement with the Federal Emergency Management Agency
<br />(FEMA), to contribute federal funds to this project, that federal contribution will be $18,750 dollars, or
<br />75% percent of the total project cost, whichever is less, and $390 dollars for administrative costs (A.3,
<br />Project Payments).
<br />e. The Department shall not be obligated to pay any amount beyond that set out in Subsection C and D
<br />above unless that additional amount has been approved in advance by both the Department and
<br />Applicant and is incorporated by written amendment into this Grant Agreement.
<br />2. GRANT AGREEMENT PERIOD
<br />Activities performed by the Applicant and payable under this Grant Agreement shall be those following the
<br />Presidential Declaration of Disaster, FEMA -1499 -DR -WA, and approved by FEMA for funding, dated April
<br />6, 2005. The project's Grant Agreement period shall be in accordance with the Applicant's Project
<br />Development and Construction Schedule (ATTACHMENT 2). However the project will not exceed the
<br />completion date of December 31, 2005 as shown in the Applicant's Project Development and Construction
<br />Schedule. This period shall be referred to herein as the "Grant Agreement period," unless expressly stated
<br />otherwise.
<br />a. The Applicant shall complete the project as approved and described in ATTACHMENTS 1 and 2. In
<br />the event of extenuating circumstances, the Applicant may request, in writing, that the Department
<br />extend the deadline for Grant Agreement completion. The Department may, in its sole discretion,
<br />extend the deadline.
<br />b. No expenditure made, or obligation incurred, following the Grant Agreement period shall be eligible, in
<br />whole or in part, for grant funds. In addition to any remedy the Department may have under this Grant
<br />Agreement, the amounts set out in Project Funding section above may be reduced to exclude any
<br />such expenditure from participation.
<br />c. Failure to complete the project in a timely manner, as outlined in Attachment 2, is a material breach of
<br />this Grant Agreement. Refer to General Terms and Conditions Section A.5 for termination actions.
<br />3. PROJECT PAYMENT(s)
<br />The Department, using disaster funds from PL 93-288, the Robert T. Stafford Disaster Relief and
<br />Emergency Assistance Act, as amended, and the State of Washington, shall issue payments to the
<br />Applicant as follows:
<br />a. Payment for work completed and submitted on an A-19, Voucher Distribution, with documentation.
<br />b. The Department reserves the right to withhold disbursement of its share of funding, as specified in A.3,
<br />Project Payment C, to the Applicant until the project has been completed and given final approval by
<br />the Department.
<br />c. Final Payment: Final payment of any remaining, or withheld, funds will be made upon submission by
<br />the Applicant within 60 days of completion of the project of the final report and an A-19, Voucher
<br />Distribution, and completion of all final inspections by the Department.
