Owner agrees that the City will not be responsible for covering or protecting openings made in roofs, ceilings, floors or walls provided the City adequately "boards up" all ground level points of access to reasonably prevent any unauthorized entry or access to the structure by vandals or any other third party. 6. Owner agrees to allow the City's Fire Department to conduct training activities within said structure from the day of , 20. 0$ , which: trainingactivities shall be completed on or before the Z day of T�ty , 20 05- , understanding that the Owner may withdraw permission at anyy time prior to the training exercise commencing by written communication to a chief officer(Battalion Chief, Deputy Chief, Assistant Chief or Fire Chief) of the City's Fire Department Furthermore, if for any reason the drill' is canceled after beginning, the City assumes no responsibility to demolish said structure:. 7 For myself, my heirs, executors, administrators, and assigns, Owner hereby agrees to waive, release, discharge, save harmless and indemnify (including reasonable attorney's fees and costs) the City of Everett, its officers employees. - and agents from any and all liability or claims for personal or real property damage, loss or destruction, cost or expense of any kind suffered by the undersigned arising out of or resulting from the performance of the Fire Department's training exercise.
