NOW, THEREFORE, in consideration of the mutual promises contained in this <br /> Agreement, and of the mutual benefits to result from such promises, the parties agree as <br /> follows: <br /> 1. Puraoses. The purposes of this Agreement are: <br /> (a) to create a legal framework to promote tlie coordination and use of Everett Trausit's <br /> and Community Trinsit's respecfive eyuipment, facilities and resources in the pro��ision <br /> of transit services to improve customer service, ieduce duplication of effort, achieve <br /> ec�nomies ofscale; and <br /> (b) provide thc mutual customcrs of Everett Transit and Community Transit thc benefit of <br /> specialized scrvices, including access to a one-seat, one-ride Bus Rapid Transit <br /> altemative along the City's most active transportation corridor as well as the potential for <br /> further extension of Bus Rapid Transit to the City's other significant transportation <br /> corridors and the extension of Everett'fransit's local transit services to under-served <br /> areas within the Snohomish County Public Transportation Renefit Area. <br /> 2. Duration. This Agreement shall be effcctive from the date of its execution through <br /> December 31, 2022. <br /> 3. Administration. Each party to this Ageement shall scrve as an administrator of this <br /> Agrecment for the purposes of compliance with RCW 39.34.030 for each paRy's <br /> respectivc actions in performance of this Agreement. <br /> 4. Bus Raoid'I'ransit aiternativc. Community Transit shall provide a new one-seat, <br /> onc-ride Bus Rapid Transit("BRT") altemative for citizens of Everetl traveling from <br /> Everett Station to King County along the corridor comprised of Highway 99, Evergreen <br /> Way, Rucker Avenue and Pacific Avenue. <br /> 5. Bus Raaid Transit Icvel of service. Community Transit shall ensurc that thc abovc- <br /> referenced new BRT altcmative mcets Community Transit's BRT service standards. E3oth <br /> parties shall comply, through abTeement or othenvise, with the federal requirements to <br /> provide paratransit serviccs. <br /> 6. Ri�hts to fares and boardines alone Bus Rapid Transit route. Community Transit <br /> will have the rigttt to keep all fares collected and count tcward its transit statistics all <br /> boardings along the above-referenced new BRT route. <br /> 7. Rceular Bus Raaid Transit stations. Community'francit shall build regular BRT <br /> stations witl�in the City of Everett along thc Highway �9, Evergreen Way, Rucker <br /> Avenuc and Pacific Avenue corridors and is currenU/scheduled to complete constructio❑ <br /> no later than December 31, 2009. <br /> / � <br />
