w <br />City of Everett - Library <br />SPU 5-88 <br />Page -2- <br />FINDINGS OF FACTS <br />1. The� Applicant has requested approval of a Special <br />Property Use Permit for the construction of an 8,500 <br />squace foot branch library building on property located <br />at 9512 Evergreen Way, Everett, Washington. The aew <br />structure will replace an existing 1,500 square foot <br />temporary building that has been on-site and used for <br />library purposes since 1985. (Maddy testimony) <br />2. The subject property is a 1.36 acre parcel of land that <br />is zoned C-1, 'General Commercial, and has a <br />Comprehensive Plan designation of Highway Commercial. <br />(sta�f report) <br />3. The Everett Municipal Code, 19.58.O10.C.1 requires that <br />• governmental buildings must be reviewed under the <br />Special Property Use Permit Section of the Everett <br />Municipal Code and that they must be developed with a <br />Special Property Use Permit. The criteria for review of <br />a Special Property Use Permit in the City of Everett are <br />set forth in EMC 19.58.O10.B (1-3). They are: <br />A. The p�oposed use must be reasonably compatible <br />with other uses and potential uses r;ithin the <br />general area in which the use is proposed to be <br />located; <br />B, The use must not have a serious adverse effect on <br />the ecology and/or environment of the community; <br />and, <br />�. The use must serve the public convenience and <br />necessity. (administrativ�� finding) <br />4. The surrounding properties to the south, east and west <br />are zoned C-1. The ptoperties to the north are in <br />Snohomish County. The properties to the north, east and <br />west are developed as single family zesidential and <br />retail. The property immediately to the south of the <br />subject property is a fire station of the City of <br />Everett. (staff report) <br />5. Immediately south of the subject property is a fire <br />station. �here i.s a small parcel of land that is <br />located between the fire station property and the <br />library property. Ttis space of land will be landscaped <br />and will provide a buffer for the two uses. (Kozlovski <br />testimony) <br />
